Laid Off from BNY After 26 Years — No Warnings, Now Seeking Legal Help”
I was employed with Bank of New York Mellon (BNY) for approximately 26 years. Throughout my tenure, I remained in good standing with the company and maintained a consistent performance history..
During the first nine months of this year, I reported to a different manager than my current one. I completed both a beginning-of-year performance review and a mid-year performance review under this manager. In both reviews, my performance met expectations, and I was never advised of any performance concerns, deficiencies, or behavioral issues. I did not receive any verbal or written warnings, disciplinary notices, or improvement plans during that time.
My manager specifically told me that I met expectations and that he had spoken with colleagues with whom I worked directly. He stated that no negative feedback had been reported regarding my work or workplace behavior. At no time was I made aware of any issues that might jeopardize my employment. There was no documentation provided to me demonstrating poor performance or any other cause for termination.
Without prior notice, I was informed that my employment was being terminated. I was immediately instructed that I did not need to return to work for the remainder of December, and that all of my system and workplace access was removed at that same time. I was not provided with any explanation or supporting documentation demonstrating cause for termination or identifying any violations or performance concerns.
I was then told that I would receive a separation agreement by email and that I would need to sign this document in order to receive additional severance pay. Specifically, I was informed that if I signed the agreement — which includes a waiver of rights — I would receive an additional sixty (60) days of pay covering the months of January and February. I was told that if I did not sign the agreement and waive my rights, I would not receive this additional compensation.
At the time of termination, I had no pending disciplinary matters, no documented poor performance, and no warning of potential job loss. I was terminated abruptly after more than two decades of continuous service, without explanation, documentation, or an opportunity to address any alleged issues. I was effectively presented with a condition where I must waive my legal rights in order to receive severance compensation following an unexpected termination.
I am currently seeking legal representation from an employment attorney or firm that has experience representing former BNY Mellon employees or handling similar wrongful-termination and severance-rights cases involving large financial institutions. I am specifically looking for counsel who has previously dealt with situations involving long-tenured employees terminated without cause and asked to sign separation agreements to obtain severance pay.

What happens when an employee is laid off after a divestiture? Like when a severance is paid how many years of service is taken into account: is it the number of years at OT or at the new company? or do employees get a severance during divestiture? what happens to their PTO days etc.

look at the list of people they need in India. if that's your current role then you might want to start writing to your senator, to Trum, etc and let them know about this. because once you get laid off, you will have to sign something saying you can't retaliate, etc, if you want your severance.
Is there a delay with the first severance check?
I was paid just fine during the 60 days, and I submitted the severance docs early on. I didn't get paid on 12/5 though. It's there a delay for the first severance check?

I refuse to work another weekend. Most days since the RIF notice have been 16 hours. My eyes are blurry. For what? Now, now it’s a priority to create documentation and do migrations. Before all this, just give to so and so.

Unknown sources leaked that 2025 will be last year to give severance based on number of work years

Nothing like going into the week before Christmas and being laid off! What a CR-P company! Looks like it is the Corporate support teams but who knows what areas will all be hit! Has this always been a thing for this company? If so, why do people stay or even start here? Is the severance worth the anxiety? Not sure if I should wait and see or try jumping ship now!

The quarterly earnings release is a good place to check for numbers. You can find it online. Q4 is obviously not available yet; these are from the Q3 report:

Yes, they can change it. But that will take time. They'll have communicate it, have to allow time for it to become policy. Even then, there will be challenges. Likely - as WF is wont to do, they'll sc--w some simply due to bad management or personal grievances. But, overall, any changes in policy will take time and have to be announced well in advance.
So to those of you who say, OH! But they are so awesome, they give sooooo much in severance!

Maybe it would be a good idea to go find a new job now before the lay-offs. The longer we wait, the less likely we will find another job with all the competition. Especially if you only get the little management severance package. Why wait ?

For those that are hanging out here after going through it, do you find these outplacement services to actually be a value or is it just a way for corporations to make themselves feel better?
Also really happy to be doing migrations of applications all the way up to 15th. Really happy to have everyone reaching out for things to be documented when it wasn’t a priority year prior. This is wonderful. What is it almost there we’re almost fricking there good fricking riddance.
Mass Workplace Relocations beginning Jan 2026
So for those of you who aren’t getting information from your managers, directors, etc., the workplace relocation notifications are going to take place beginning first or second week of January. If you’re not in one of the 40 key network locations, the four hubs or one of the 10 to 12 other approved locations you will be getting notification to move to a new office location.
If you’re within 50 miles of your new location, you’ll be expected to start reporting within 60 days. If you’re over 50 miles you will have 60 days to say whether or not you will accept the new location assignment if you say yes you will have until late spring early summer 2027 to make the move if you say no in all likelihood, you’re off the payroll by June 2026. If you say yes, and then the year passes and it’s time for you to go, and you say no, you’ll be terminated without severance.
Everyone, regardless of your role or your organization is affected. Whether you’re a national employee, original employee or a market based employee all these rules apply and many of us are already being told unofficially where we’re headed.
This is all part of a two prong effort to reduce headcount and also reduce real estate footprint. So the company will reduce real estate footprint and obviously save money by selling off those buildings and/or ending leases. Secondly, they’ll save money with a reduced headcount because there’s going to be people who say no right out the gate and others who will leave the company in the term or when the time comes further reducing headcount considering how many people this affects it’s gonna be a pretty steep cut in headcount when it all shakes out.
Negotiate a Better Severance Package
I was able to negotiate a better severance package. The company recently bumped up its severance fund to $205 million, so theres more room to work. I got extra compensation and more months of outplacement services. Definitely try negotiating. They're open to it and it's worth asking
