Delivery Partner Contract Terminated

A Washington-based Amazon delivery partner has ceased operations after its sole client, Amazon, terminated their contract. This abrupt decision resulted in the immediate layoff of 120 employees. The company cited an unforeseeable and last-minute notice from Amazon as the reason for its inability to provide the required 60-day WARN notice. Affected roles included drivers, dispatchers, helpers, an administrative assistant, and a manager. The closure is expected to be permanent.

What laid off employees should know

Are U.S. employees laid off and then replaced by H-1B or L-1B workers performing substantially the same work? Has that happened ever....

If your employer laid you off while hiring or transferring H-1B or L-1B workers, these are the main laws worth asking an attorney to investigate:

H-1B displacement law — INA §212(n), 8 U.S.C. §1182(n)
For covered employers, replacing a U.S. worker with an H-1B worker doing an essentially equivalent job can violate the law.

H-1B recruitment requirements — 20 CFR §§655.738–655.739
H-1B-employers must make good-faith efforts to recruit U.S. workers and offer positions to qualified U.S. applicants.

L-1B requirements — INA §101(a)(15)(L), 8 U.S.C. §1101(a)(15)(L)
L-1B status is for employees with specialized knowledge who are transferred from a qualifying foreign company to a related U.S. company.

L-1B fraud or misrepresentation — INA §212(a)(6)(C)
False statements or material misrepresentations in obtaining immigration benefits can create serious immigration consequences.

WARN Act — 29 U.S.C. §2101 et seq.
Large qualifying layoffs may require advance notice. This is separate from H-1B and L-1B rules.

H-1B whistleblower protection — INA §212(n)
You may be protected from being fired, threatened, demoted, or punished for reporting suspected H-1B violations.

Retaliation laws
An employer generally cannot punish you for making a legally protected complaint about unlawful employment practices.

Title VII — 42 U.S.C. §2000e-2
Discrimination based on national origin is prohibited.

INA §274B — 8 U.S.C. §1324b
Certain discrimination based on citizenship status or national origin is prohibited.

Some U.S. citizen employees reporting to IDC manager are required to work midnight/overnight hours while comparable employees reporting elsewhere are not, these are the potential violations to investigate:

National-origin discrimination — Title VII, 42 U.S.C. § 2000e-2
If the different scheduling is because of national origin.

Adverse working conditions for U.S. workers — INA § 212(n), 8 U.S.C. § 1182(n)
Particularly relevant if other employees doing comparable work receive better hours or working conditions.

Overtime violations — FLSA, 29 U.S.C. § 207
If the overnight schedule results in more than 40 hours per week without required overtime pay.

Are they being intentionally toxic to avoid having to give another WARN notice?

I am part of the Splunk organization and our team has been handed over to the most toxic manager I have had in my entire working career. We couldn't tell if they were exceptionally stupid or if this was a strategy to get our entire team to quit without severance. On the .Conf floor, I learned there are other teams facing the same situation with their management. We've already had two folks quit that I have worked with for 10+ years. Did John Morgan instruct his management teams to find ways to get us all to quit so they don't have to pay out, or is the company culture to just hire trash directors now? Wondering how many other people are facing this.

Sep 14–16 – What We’re Hearing

Note: Used AI to clean up and organize the wording of this post. The information and content are based on what we’re hearing from our contacts. AI did not generate the information.

The dates being discussed are not completely baseless or intended to add fuel to the ongoing rumors. They are based on information we are hearing from reliable sources.

The dates being mentioned are Sep 14 for the US and Sep 14 or 16 for IDC. One reason being discussed is that last time there were legal considerations around the Sep 2 timing and stock vesting, so there may be an effort to avoid similar issues this time.

Again, none of this is officially confirmed. This is simply what we are hearing.

If multiple people on Blind and here are independently talking about Sep 14, there could be some truth to it. Something similar happened last year when there were a lot of rumors about Sep 2, and the layoffs did happen on Sep 2.

Potential impact:
——
Based on what we are hearing, the impact could be mostly GVPs, middle management (M2/M3), and some ICs. But this is also not confirmed

###What you can do between now and Sep 13 midnight.
————————————-
1). Back up your personal materials
——
Do not take Oracle proprietary or confidential materials. But download your personal documents such as paychecks, benefits information, contact details, performance records that you are entitled to keep, etc

2). Get your personal laptop ready
——
Have your personal laptop set up with everything you may need for a job search. If something happens unexpectedly, you don’t want to be trying to transfer everything from your work laptop at the same time

3).Understand your health insurance options
——
If you’re concerned about coverage, call Covered California this week and understand your options (Blueshield Silver instead of Cobra etc) before you need them. Don’t wait until the last minute. Also understand how WARN and COBRA work so you can make an informed decision based on your situation.

4). Review your life insurance
——
If you currently have employer-provided life insurance, understand what happens to that coverage after termination and consider whether you need a personal term life insurance policy to protect your family. You can buy 20 year term insurance plan this week

5). Be prepared for the process
——
If a layoff happens, you may receive a meeting invitation such as a ‘business update’ with your manager Sunday night or Monday morning (or just an early morning email). They will explain the next steps, including severance, benefits and returning company equipment. Follow the official instructions you receive.

6). Don’t panic
——
If it happens to you, take a breath. Understand your severance and benefits, and apply for unemployment through EDD if you’re eligible. Give yourself some time to process everything.

7). Start preparing now
——
Update your resume and LinkedIn profile. Start applying for jobs and consider using the time to upskill, especially in AI. You can spend part of the day applying and part of the day learning. It may take some time, but don’t give up.

Layoffs are happening across the industry, but the uncertainty and repeated restructuring can be very stressful. If something does happen, remember that it is not the end of your career. Take care of yourself, stay positive and focus on the next opportunity.

Hopefully none of this happens 🤞 But being prepared is better than being caught off guard.

FIS Warn Notices

How is FIS getting around filing WARN notices in states with all these rounds of layoffs? I know there're legal issues in Washington state after layoffs last year but I am amazed that no WARN notices have been filed this year (Wisconsin). It seems the March & June layoffs should met the requirements for a state notification. Anyone know more about how they are getting around this?

A union has filed a complaint against Amazon and its subcontractors for allegedly violating New York's WARN Act. The complaint claims over 1,300 delivery drivers were let go without the legally required 90 days' notice. This action impacts drivers in New York City and surrounding suburban areas. The International Brotherhood of Teamsters is seeking back wages, benefits, and penalties for the affected workers. The state Labor Department is currently reviewing the complaint.
