I feel like we could argue that layoffs were gonna happen anyway- but anyone know?

There are always exceptions, but accepting a VSP is legally classified as a voluntary quit. Anyone who took a VSP, regardless of the state, will have to file their case with their state unemployment and will have to have proof that their position was on the "chopping block" for a massive lay off. I imagine it would be a hard case to prove. I don't know why anyone would take a VSP and not already be applying for jobs. I'm using mine as a buffer time to find a job and if I find one before my date I'll quit. VSP just gave me a for sure last date of employment vs waiting to see if I got laid off.
In TX. I called them during the VSP decision process and they told me for the type of separation we were offered, we would not be eligible for unemployment. You would ALSO need to check the VSP documents if you were approved because that is usually one of the rights you give up with this type of severance.
Feels like a question that one would have asked BEFORE submitting the application.

Best thing to do is to call your unemployment office and ask
