Layoff Severance negotiation

Has anybody been involved with IBM for severance negotiation during layoff in the united states through an attorney . What is the outcome when the attorney is not successful in getting a bigger package . Does IBM still pay the 3 month severance even if you tried to negotiate through an attorney ?

I reached out to some law firms who previously had won lawsuits against IBM during my 30 day notice period but when none of them seemed interested in taking a case on a contingency basis I decided it was best to just go ahead and sign.

All bets are off if you do not take the package within the prescribed acceptance date.

Not accepting means no severance and a army of corporate lawyers descending and crushing you in years of drawn out litigation aimed to financially ruin you .

Accept your fate and move on …

@v2 if you take the severance and sign you waive your right to sue. I would think if you sue and lose you don’t get the twelve weeks as you wouldn’t have signed

You are wasting your time and money. Start focusing on your next steps NOW. No company negotiates severance related to layoffs. They have the law on their side at this moment. Everyone laid off will get the same package. If down the road it can be proved the scope of the layoff was discriminatory that will be the time to get representation and negotiate. This is for US.

I feel like hiring an attorney for a severance agreement is the biggest waste of time and money unless there’s clearly something unlawful or you have an huge amount unpaid work/commission. All of that severance money they would owe you would just straight to the lawyer.

IBM is going to have a fierce legal team. You can’t just hire some no-name attorney to battle with their IBM’s legal team.
