54 years old and second PIP

There is an engineer in my group who was less than a year away from reaching retiree status who was put on a PIP. She was put on a pip five years ago as well so is now fired. Fired months from being able to receive retiree benefits after more than 30 years at Exxon. Now she is fired and no longer eligible for the retiree benefits. Are others seeing this as well?

Exxon is running a multi-year RIF in front of everyone's eyes and nobody is saying a thing.
You can't blame the company for getting away with what it is able to get away with. Employees need to speak up
Everything: your promotion, your pay, whether you get put into certain jobs or not, all revolves around your age. Not a single other company in the United States would be doing this without penalty. Our employees follow what they're told without thinking and this is another example You were told this is OK and this is right and this is about experience, and you believe them. You're wrong and you should do something about it

Someone formerly at a Shell campus in Houston is suing right now for losing out to DEI hires with no experience and being told it was because they were white and literally being given a “jar for their white male tears”. That’s a quote from the lawsuit. That was a real thing that happened. Google it.

All of the lawyers in the world won’t stop even the biggest companies from losing in court. But they do need to cross a line. So keep your eyes peeled for that. These loser egotistical executives are not infallible and are in fact deeply flawed and greedy and so mistakes happen.

@ah Cool story, but these things rarely (if ever) go to court, let alone trial by jury.

Standard practice is for opposing counsel to negotiate a settlement behind closed doors. That’s usually as far as it ever goes.

If/when someone does decide to fight a company like Exxon in court, they will deploy the full firepower of their world-class legal talent (these people argue cases before federal appeals courts), bury you in procedural costs, force changes of venue, and rip your character to shreds.

Oh, and the process can take years to litigate.

Unionize or roll over and take the abuse. Those are your options.

This is disgusting. This type of behavior led by the policy that is endorsed by the Executives and Management Committee absolutely speaks to the fact that the ethics and morals of the company are missing. This type of action is exactly what the business practices review tries to prevent so now, the BPR has no basis for being followed by anyone. Good job in proving your true colors Darren. This guy is a joke and will be forgotten once he retires. He can take every dollar to the grave because that’s all he’s got.

@cf I’m not on salary so I didn’t think about losing RSU’s. That could be a significant loss. Does the pension formula change if you don’t make it to 55?

@ce pension is significantly reduced, RSUs taken away. Can be significant for someone who has been with the company for a long time if they were previously a high performer with significant RSUs.
I wouldn’t get too worked up on losing medical, ACA govt insurance is comparable now, depending which plan you choose.
If she turns 55 at any time this year she can access 401k without penalty via Rule of 55. If she turns next year she has to wait until 59-1/2 or pay penalty.

How can someone work 30 yrs without being targeted for firing except right before her tenure for retirement? That’s morally disgusting on so many levels. Meanwhile all the old
Executive people hang out past 65.
