RSUs and Deception: Lawsuit?

Curious, if anyone else thinks there's a case here. It would seem that Oracle, grants certain employees RSUs. The intent is to get those employees to stay and remain engaged over the vesting cycle. RSUs are valuable, no matter what the stock price is.

However, part of the RIF process is to cut individuals that have large amounts prior to vesting. It's not by accident, it is a standard practice. Seems to be deceptive. I'm curious on thoughts from this community.

@cj interesting…I’m at 6-figures base, plus comp, plus RSU’s that pay annually…I guess we’re not equals.

Note severance is based on low base pay so yes RSUs are used to motivate you but no guarantees on receiving them.

A decade in, get RSU’s on the 4-year vesting cycle without fail every year. They pay out every year. Never been cut. No conspiracy.

RSUs 100 percent were considered - I have heard it from US M5 in my GBU. They are trying to get back some people that were impacted - I know multiple who have been contacted to come back as transfer to another team - US office.

A lot of employees at Oracle get no RSU at all. Or raises. Oracle is right to lay off the glorified coders. They are just not worth their comp. Never have been. The market is coming back to the reality now.

It’s your choice to join if you don’t like the employment terms don’t join. It’s that simple. If you failed to negotiate your offer that’s on you.

That employees' RSUs were vesting during garden leave, even though grant documents say they don't vest during garden leave, will make a lawsuit difficult.

There is no documentation proof to point RSU was considered, even if they did. There is no point for legal battle. Waste of time. Find a different company.

Agreed, but it will never change. You wont win this case. Save your energy for finding a good company. One that does values its employees. And take this lesson with you: dont settle for what you got at Oracle for bonusses. The RSU system is ridiculous

Agreed. It’s a carrot on a stick. RSUs are presented as part of your compensation, yet if you’re RIF’d before they vest, you can lose them. Instead of a larger raise, companies can put more of your compensation into equity that you may never actually receive.

It’s ridiculous that it works this way and something I think should change. If you’re RIF’d through no fault of your own, you should be entitled to at least a portion of your remaining unvested shares, maybe 50%.
