Does anyone have a definitive answer as to our severance affecting when one can file, and if the severance is really severance at all? Isn't it a payment from the employer to the employee to release the company from liabilities ? And if so, this release will be signed and agreed upon before filing for unemployment insurance benefits. It seems the TWC sees this however they want to.

My experience was more like dyy than iur. After the severance period you should be able to collect. Iur seemed to get lucky fir getting it through.
TUI will figure out your weekly amount. Any money you report will be counted against that total. You receive 6 months salary, you are not eligible for benefits for that timeframe. If you are pension eligible and the amount you receive is more than the calculated benefits you are not eligible. Depending on your status and financial situation you need to plan your income stream to put yourself in the best place to get the benefit. Because most folks at AT&T make a decent salary you can count on around 500 per week. If you are pension eligible and have savings to supplement then delay the start of the pension benefit. Benefits run for 6 months. Obviously some don’t self report any income and it seems that they don’t have a mechanism to check but there is a statement on the form that if you report fraudulently it is fraud.
I filed when I was laid off. When you request your UI payment each 2 weeks, it will ask you if you’ve received any other payments. I answered no for the first 1 1/2 months. When i received my severane check, I said yes. Well, they denied my benefits, I appealed and lost. Had to pay it back. There was a rule change a few years ago that made that happen. However, after 6 months, you can file and won’t be denied.
I have filed. It was approved as far as I know.
You will likely have to appeal TWCs decision to deny you UI. First, the General Release Waiver you signed in order to receive the severance payment was in exchange for waiving your rights and AT&T from all liabilities should a lawsuit take place. You pretty much agreed not to participate in any class action lawsuit. Second, state to TWC during your appeals hearing that the severance was a one time lump sum payment and not for a period of time. You will be denied UI payment just for the week the severance was paid to you. It also depends who your TWC officer is during your hearing. I was very fortunate that the officer for my hearing sided with me. Be prepared to send the officer a copy of the Genearal Release Waiver for him/her to review. Good luck!
