Thread regarding AT&T layoffs

FYI

On behalf of Kevin Costello of Costello & Mains, LLC posted in Workplace Discrimination

Usually, when the public discusses workplace discrimination, they are referring to some type of unfair treatment against a certain race, religion, s-xual orientation or gender. However, while these are some of the most common types of discrimination in the workplace today, they are by no means the only types of discrimination that can occur. Communications giant AT&T recently received a class action lawsuit alleging that their new emphasis on staffing with technologically capable individuals operates on a discriminatory bias.

According to the suit, the company chose to institute a wide-ranging layoff that targeted older workers in an effort to thin the herd and make room for younger, more theoretically technologically-inclined employees. The suit further alleges that the company very intentionally structured its layoff procedures to avoid the appearance of discrimination, despite the fact that the process was broadly discriminatory against older employees.

The company allegedly moved employees around to various job statuses so as to not arouse the suspicions of any regulatory agencies. The company also allegedly informed individuals that if they chose to accept a severance package when it was offered to them, that this would preclude them from filing a discrimination lawsuit. Not only is this untrue, it doesn't look very good for the company, which claims that it does not tolerate discrimination of any kind in any of its operations.

If you believe that your employer discriminates against workers of a certain age, or commits any other type of discrimination, you should absolutely reach out to an experienced attorney who can help you review your circumstances and identify any grounds for legal action.

I challenge you to walk into an APPLE STORE and take an accessment of the diversity of their employees . Next drive down the road to your local AT&T Company Owned Retail Store and do a comparison.

For years all AT&T wanted was to be APPLE. Epic fail. Now along comes the shiny new “TIFFANY” (please someone hide Randall away) called TIME WARNER and all of the sudden the T is The first man on MARS and who really cares about that diversity c-ap. WE ARE ON MARS BABY!!!

By the way TIFFANY & WALMART you should really be insulted by his remarks. Epic fail.

@1wxr you don't have to do that. there are plenty of options out there that give you more control of your time and how much you make. it will require hard work on your part. I still depend on ATT but I have a plan b that does not require ATT. take a look at whats out there, good luck.

@ihvc I would opt out of cwa, but I honestly don’t trust ATT . If ATT didn’t act like they hate their workers they would have an easier time moving away from the union.

I really like my job and it’s a good job and I want it to stay a good job. I really don’t want to end up a contractor making 12 bucks an hour with no 401k and very little time me off and no work life balance.

We are stuck between two b---s---ters but at least it’s a good job.

Hard to decide which factor of the union is the most offensive. The stewards who walk around the yard like they own the place, getting paid time off, kissing the a-- of management and stabbing anyone in the back to curry favor. The sh--ty contracts that they pretend are the best they can get, always feels like they have served themselves first, membership be damned. Or after the taking of your money, the emails describing the really offensive politicians they are supporting.

I dont know if I should start this with huh or what the huh ? We the employees have been paying out Thousands of dollars every year to CWA . And in return we get a weak a-- contract every 4 years , we see union reps in our yards get more and more paid days off , no, to little, representation for us, and the general attitude from the union of ..... There is Nothing We can do,Duhhhh ! just be where your GPS says you are and be a good loyal little worker who doesnt rock the boat ! And now I am reading that if I feel that I have been a victim of age discrimination at ATT , that I should reach out to an experienced lawyer ! Huh ? after all the money I forked over to CWA I need to hire a private attorney ? Really ???? A Private FFFing Attorney ???

When I was laid off from AT&T in January, my supervisor told me flat out I was cut because she wanted someone younger in my job. In the reduction last fall, 5 out of 6 people cut in my group were over 40. (The sixth one was a 20-something who had screwed up everything he did and ticked off everyone he worked with so badly that even being the executive director's drinking buddy couldn't save him.) AT&T doesn't try to hide that it wants to get rid of older workers. Not even a little.

The binding release had illegal clause language that could otherwise be challenged, under federal law older workers protections are demmed protevted, no comoany can preclude or enforce the right to sue in a federal case by design

tsk tsk tsk, and what will the potential impacted employee do for money while they wait for a suit to either be settled or adjudicated int eh courts (years especially if it has to go to the US Supreme Court)? Severance payments will only occur if one signs a binding release. so, what do you all suggest?

I am horrified that you left discrimination based on military veteran status off your list. It's not ok to ignore that segment of society just because they make you feel uncomfortable.
