Would this cover the lay offs to ASMs at the beginning of this year I wonder? It was very obvious that only high tenure employees where let go and no jobs were there to apply for during our 60 day surplus status. Every attempt I made to apply for a job was put off. Even after I left and still tried to re apply, I was ignored or positions were not posted but still somehow filled with newer and younger employees. What AT&T did was very unfair and favoritism was obvious with the very few that were saved.

I now we all know AT&T would never discriminate against older workers. That's against AT&T policies. They would never do anything like lay off older workers. Randal is a fine, upstanding, Christain man and he would never allow this to happen on his watch. These lawsuits are without merit.

As reported via news dated July 3, 2017 ( see below news link url). It is a class action lawsuit.

The news states:

"The five named plaintiffs, which include three from New Jersey and one each from Florida and Arizona, brought the suit on behalf of themselves and on behalf of all former company employees over 40 who, since May 2015, received a letter notifying them of their "surplus" status and were then terminated on failing to secure another job, and who were offered a severance payment."

I thought the surplus list was strictly based on seniority. If the least senior techs in a group are all 65 years old, they have to go if a surplus is announced per our wonderful CWA.

I called the lawyer mentioned in this post. Unfortunately it's not a class action lawsuit so none of us are going to get any more money from AT&T.

I wish you all the best with this case. Class Action cases really punish the offender. It is such a shame that this is happening after years of dedication. It's coming up on 7 years for this one.

This is awesome. if you read the second link it tells the entire story of what we went through. Even the part on looking for a job while on surplus status. These miserable creeps deserve everything they get...especially the corrupt HR / DOS folks. It's the same for every state but rings true here in Michigan.

The suit was filed by Stephen Console and Laura Mattiacci of Console Mattiacci in Moorestown. Console Mattiaci has had a string of victories in age discrimination suits

Workers wouldn't t find new employment with the company by design were offered severance if they agreed to sign a waiver saying they understood they couldn’t bring suit under the Age Discrimination in Employment Act. But the release waiver was void, the suit alleges, because the papers are unenforceable under ADEA rules,
