Thread regarding Oracle Corp. layoffs

Time you get wth WARN and without!

Can someone explain the 2 scenarios, lets say an employee has 10 years at Oracle.

with WARN notice:

2 months (WARN) + 1 month (for first year) + 1 week for the rest of the 9 years

so total : 3 months/9 weeks ( you will keep insurance+ salary during this time)

without WARN notice:

0 months(No WARN)+1 month (for first year) + 1 week for the rest of the 9 years

so total: 1 month/ 9weeks ( you will keep insurance+ salary during this time)

please correct me if I am wrong.

With WARN, the laid off employee will only get one extra month of "in lieu of notice" pay if Oracle doesn't announce the layoff. They will consider the four weeks of pay they give to everyone as a part of their 60 day WARN obligation. Also, in this case, the paid COBRA coverage will be extended for the second month.

It is very unlikely that Oracle will hit the WARN limits anytime soon, so this scenario is not very likely.

Honestly, the difficulty I'm seeing people on here having with understanding WARN, the 2 months' notice/salary and how it relates to the lump severance at the end makes me pretty confident that Oracle has done the right thing laying us all off.

Your calc is wrong. They subtract the two months from your severance. Warn helps short term employees.

Take all the money you can, you have no obligation to tell oracle anything. They are being total A:holes, a:hole them right back.

what happens if I get another job while on WARN and do not inform O about it? I know that they say we should inform , and then they will consider it as normal resignation and not give me rest of severance pay. but how will they find out?

Also note than in many states, your first unemployment check will be delayed if you received any severance and unused vacation pay.

OQPsQUJ-abw is correct. Plus one additional advantage. If your severance was less than 9 weeks (60/7 = 8.6) you get the full 8.6 weeks of pay.

What I have heard is that if you do get WARNed, that the 60 days comes out of your severance package.

There are two positives if you get WARNed:

1) You keep your health benefits for the 60 days

2) When you apply for a job, you can say that you still work at Oracle, without having to lie.
