Being surplus, was planning 6.5 more years for early retirement w/pension, do i have a case in CA?

Depends, does your state have right to work laws prohibit union security agreements, or agreements between employers and labor unions, that govern the extent to which an established union can require employees' membership, payment of union dues, or fees as a condition of employment, either before or after ...about 25 states have this, if you are one of them, you have no case

I'm in the same situation, say I have less than 6yrs to go for early retirement, where I could get $2K/mo for (say I'll live for) 20 years (that's worth $480K!). But now I'm being surplus where I'm only allowed to get my pension balance of $90K. Do I have any legal grounds to pursue?

@2ptz...i got 100% of my pension's value at 38 yrs old. Are you referring to the tax penalty?? then yes. Its somewhere around 50%.

Depending how long you have been with the company you only get 50% of what your pension is valued at (since you did not reach full retirement age). So you can see why this would make someone extremely upset if you are 50 years old and only 2-3 years away from earning what they worked so hard for.

Nothing happens to your pension if surplused. You have a few options: 1) let it sit in Fidelity until you reach the age to withdraw 2) withdraw early with penalty/tax 3). roll it over to another bank.

Doesn't matter. I was only 3 years away from retirement. Thank-you AT&T from taking away my pension option AND at an age where it would be hard to earn another pension anywhere else.

Check with your local equipment employment opportunity commission. If they agree you have a case then secure the services of an employment lawyer. I had one employment lawyer that AT&The makes it very easy to win these types of cases.
