As poorly as this Surplus has been handled, a Class Action Lawsuit is very winnable. Its not too late to pull the plug on this thing and limit the damage. The Lawsuit could end up costing the company ten times the savings they could get from the surplus. Limit the surplus to volunteers and the very low performers (those with a history of not meeting expectations). Anything else and this thing is going to get a lot uglier.

you have nothing to sue for. ATT at least has given people a heads up their jobs are going away years ago an now with a few weeks notice that something is happening. Try working for one of the retailers that cut peoples hours until they have to quit or stores that close up shop 1 day to the next with no notice and no severance to 10+ year employees and give them the option to move 100 miles away. its a horrible situation and shows a lack of respect and gratitude when they leave people hanging but not unexpected. they haven't broken the law and companies that treat people way worse are within the law.

Well I won't be joining don't care if I double my severance. Waiting for years means stress and keeping this on your mind for nothing, really.

Thousand of people would join to make ATT pay, many signed wavers, therefore no cash benefits will apply, but they could pay big time if found guilty, very possible

Huh? Most employees are in "at-will" states.
Yes this time delay has sucked but get real. Compared to a lot of large companies the severance package is pretty good if you've been around a while
