Thread regarding Verizon Communications Inc. layoffs

5.2.16 Bargaining Update

V Team:

Today, we met with the New York/New England unions and they made a proposal that was not constructive. We rejected the unions’ proposal and reiterated that they have our last best final offer.

We will continue to keep you updated.

Union employees are just a bunch of people who have been brainwashed by their master. No negative but all positive information. Do you think it is possible? If you really want to talk about laws, how about ask your master where is the 500 million strike fund, why do they need people donate if they have such big amount of money to support those families who really need help during the strike.

Yeah because those lawyers have a different set of laws they get to follow. The law was just pasted in the previous post. Not too hard to read it. Prove that last post wrong.

@HdqHVlZ-tvp Give me a break. Stop copying and pasting from website. You are not a lawyer obviously. Union has lawyers and they know what is going to happen. They just want you union folks hold the line by sugarcoating the truth which will hurt their leadership. By the way, the company has lawyers too. If you really want to challenge those company lawyers, you better spend 6 to 7 years in a law school first.

You assclowns make no sense. Verizon has a contract on the table. If we lose then we take what we get. We will be back no matter what. Even with impasse they can not just take everything away that they are offering. We would basically get what they are offering now. Here is some info on an impasse and how it works.

  1. Unilateral implementation.

The employer may unilaterally implement where the parties have gone to impasse. So, if the employer gives the union a "take-it-or-leave-it" proposal and the parties go to impasse the employer can implement that proposal.

  1. Impasse

Impasse occurs when "the positions of the parties have solidified and further bargaining would be futile." (2001 MERC Lab Op 28, 32 (Mecosta County Park Commission).

The declaration of one party that there is an impasse does not mean an impasse, as a legal matter, has occurred. An impasse only occurs when neither party is willing to compromise.

  1. Preventing impasse.

A. Fact Finding

Under PERA an impasse is prevented when a request for Fact Finding is made with the Commission. The employer may not unilaterally impose its last and best offer until fact finding is complete and the parties have had an opportunity to bargain over the report of the fact finder for a period of 60 days.

B. Information Requests

An employer is required to furnish, on demand, factual information concerning issues in bargaining or in a grievance proceeding. The duty to supply this information is part of the duty to bargain in good faith. The union, acting in good faith, may forestall impasse by making information requests to better understand the employer's final position. The information provides may lead to proposals by the union that will start bargaining and forestall impasse.

Also read the part about regressive bargaining and direct dealing. Now look at the company.

VZ is not budging. This is not a money issue. There's no middle ground. It's either job security or not and closing call centers or not. VZ is not going to budge on those two because it just doesn't make sense for them to if you look into the future.

The real question is how long are EWAs gong to be on asssignment because VZ can be opening a can of worms if this thing goes into summer.

Hey @hoc -- you can't come back whenever you like. You can come back when you get permission from your union bosses -- the ones currently enjoying getting a paycheck and benefits.

Let's not act like you have any control of the matter.

There's no impetus to lock out. Union Bosses have made it clear that they were voted in after the last ones failed to competently negotiate the last contract and are going to hold out for several issues which they say are non-negotiable this time as per the update call yesterday. VZ is not backing away from last best final offer. Per union call they are not declaring an empasse. VZ is hiring hundreds of contractors, some have already started, hundreds more have orientation 5/9 just for NYC area. Most are former comcast/tw/sprint etc workers w/field experience who are OK with not being employees and making $28/hr + $128/day cash per diem(source:careerbuilders.com).VZ has no intention of bringing back union workers unless they come back via crossing picket line. They want nothing to do with bringing back the union.

All I can see the public support are from CWAers' family, teacher union, some socialist groups or some Congressmen. Most of them are in NY or NJ, especially New York City. If you guys cannot be supported by those mainstream media, then you might as well resign and cross the picket line.

Been here 21 years and never seen anything like this. Media coverage has been almost non-existent since Bernie moved on and laid off most of his team. Nothing in the news on tv and very few articles online. Stock price has shown little/no impact. Surplus of experienced people looking for work anyway they can find it after so many corporate layoffs the last 5 years (contractors). Vz execs appearing to have expected and potentially baited the strike. Biggest EWA phase 1 workforce percentage compared to jobs walking out ever with phase 2 already in training and phase 3 contractors already staffing up within 3 weeks of strike. This is rough but hasn't been the same chaos I've seen in past strikes. This appears to be much more organized and planned out.

VZ has negotiated in good faith.

The union has not.

No, you cannot come back anytime you want.

Those hired during an impasse have priority over

those who are on a strike. An impasse can be argued

retroactively by Vz. Yes, you can sue, but previous experience

with nlrb suggests that you will lose. The current lack of progress

in the negotiations is legally sufficient for arguing an impasse.

Well maybe if you leave mommys basement, you would actually talk to REAL LIVING people and find out something for yourself. If you believe mainstream media, who by the way are owned by the same corporate class we are fighting, then I don't even want to continue this talk. And btw opinion pieces are NOT considered reliable sources. Read this for facts about vz

This year I have seen more support for this strike than any strike I have participated in during my 20 years working for the company.

Terrible timing by Vz Management, good timing by the union which was the underdog in this fight!

I know you company cheerleader guys are not going to admit it, but that's ok. You are still saying go90 was great too.

@HdqHVlZ-kpk Why do you think the company didn't negotiate with Union in good faith? Verizon is not charity. Yes, you can easily claim a NLRB violation. But whether there is a violation or not need to be determined by NLRB not you.

With all the layoffs over the last 5 years, this is probably the biggest surplus of contractors with experience that has ever been out in the market. Agree with -ubm. Company won't even try for permanent replacements. No reason to.

Temporary, contracted labor is probably what Verizon would prefer. No severance packages needed when things slow down. I notice more and more of the people I deal with daily are either contractors or overseas labor. This people will gladly fill your spot "temporarily" even if they have to do it for years.

Union will hold out for job security clauses and VZ is not going to back away much at all from current offer. VZ has no intention of hiring perminent replacements. Their intent is to use non-union contractors, and they will remain non- union contractors. This way they avoid all of the expenses that come with employees. They can just leave them as contractors, thus not violating labor laws. Welcome to H&H bagels!

One side says duty to continue bargaining. The other says after close to a year of negotiations the situation has reached impasse that will not be resolved, thus the "last, best & final" offer. Seems like mediation would be the way to go if that's even still on the table at this point.

Putting retrogressive proposals on the table and not budging is not negotiating in good faith either. Just because you offer a raise doesn't erase the fact that Vz is not negotiating. Do the math

No permanent replacement but temporary contractor. I think that is the company wants.

The only time they can hire "permanent replacements" is if we were on a "purely economic strike" then yes they could but unfortunately for Verizon it is not. We can easily claim a nlrb violation as not negotiating with the union in good faith is a violation. Has Vz wireless even had any discussion from Vz side? I think not

I will believe the "lockout" when I see it, until then it is just talk on this board. It is not even week 3 of the strike. Union has gone this long before it isn't even a big deal yet.

I believe if Verizon were to lock out and replace all their union workers, (I am not well versed in labor law, just for the sake of argument lets say they do) I believe if they did it and broke the union, it would be a pyrrhic victory for Verizon.

Again, we will come back when WE decide to come back. If you believe that that's the l"last, best, final, be all that ends all, never going to change, unless pigs fly" offer, then I have a bridge to sell you. Legally the company can't do much at this point as they will be open to a lot of liability through the nlrb. If you took the time to read and learn something before you spoke maybe I wouldn't have to type so much. Actually it makes me wonder why you are even in this site, spitting all this nonsense? You must either have no life or you were bullied as a kid. For someone to be wishing others so much hardship tells me your parents did a horrible job with you. I feel sorry for them and you. Maybe you should get from behind your computer/phone and go try to meet a girl. Losing your virginity should brighten your day up a little at least. 🤔

@hoc: I hate to be the one to break it to you but your window of time to "come back whenever we want" is getting shorter by the second from what I'm hearing.

The union called Verizon's bluff and you're about to find out exactly what a lockout is and exactly what it feels like to not have a job waiting in the background. In 2011 the union had some leverage, but in 2016 you don't and the company knows it.

The bad thing about being a pain in the asslike the union has been is that when people are tired of you and they have all the leverage they will do whatever they can to let you go be someone else's problem. You are about to find out what I mean.

Yes hoc, you can come back when you agree to terms. Not a minute sooner.

You've seen the terms. You can either come back and only be unemployed for a few weeks, or you can come back six months from now in bankruptcy and take the job then (except by that time the job will already be someone elses and you'll be looking for work at Level 3 for half the pay and poor healthcare coverage).
