Thread regarding Verizon Communications Inc. layoffs

Your union didnt file Unfair Labor Practice charges.

Everyone of you can be replaced with permanent workers. Everyone except for the 7 Verizon Retail store workers.

Doesnt the Union explain anything to you sheep?

@trm - I checked it - you are correct. As long as negotiations are happening, this cannot be a ULP strike.

Since it is an economic strike - Union employees can be replaced. However, If the company ever decides that they will not bargain with the union, then ULP charges can be applied.

Here's the catch...... once negotiations are stalled and can be legally defined as futile, then an impasse can be declared. An impasse will need to be a fact-laden legal determination. But when an impasse happens, then the duty to bargain is suspended.

In most cases an Impasse can take months or even more than a year.

so for you union strong.... settle in for a while - your jobs are not safe. The company will need to keep business going in order pay their existing employees.

Although the NLRA protects the right to strike, employers don’t have to shut down for the duration of the walkout. Employers are legally allowed to hire replacement workers during the strike. Once the strike ends, the employer’s obligation to bring back striking workers depends on the reasons for the strike:

Employees who strike to protect an unfair labor practice cannot be fired or permanently replaced. When the strike is over, these employees must be reinstated to their jobs, even if means replacement workers have to be let go.

Employees who strike for economic reasons have lesser reinstatement rights. Although they cannot be fired, they can be replaced. If the employer has hired permanent replacements, economic strikers aren’t entitled to immediate reinstatement. Instead, they are entitled to be called back for job openings as they occur.

@trm. ..... I will check your info with Section 7 or 8 of NLRB. To see if that is correct. But unless there are no Unfair Labor Practice charges.....anyone can be replaced permanently.

As long as they are still negotiating then you have no need to file ULP charges, thats why it is not a final offer.....when the company stops negotiating claiming they will not move on their offer then you can file.
