When to file for unemployment in TX (before/after severance check)

Does it make any difference whether you file for unemployment before or after receiving your severance check ?

Does the TWC apply your severance payment to several months and deduct from unemployment (~$400/week) ?

Do you wait until you received your check from CVX and then you can rightfully claim 'NO Income' ?

Forget about interest and profit, do everything to get maximum control over your money, most banks will freeze and limit accounts in order to use deposits to bailout themselves. A lot pension money and other savings will be lost. Take out your money from shares and convert to cash, take a lot of cash to home or some safe place. Distribute money into several accounts. Buy gold. Have a lot of food and water at home, have generators and weapons. Better move to small towns.

I would suspect that if the expenses include any "wages, tips, or compensations" for yourself then you are employed. It's pretty clear. If you have any income and you have to check that box, you lose that week (or delay it). That doesn't mean you can't still file continuously to remain active for the first week that comes up with no income. Also, I understand that the balance is fixed, you can take up to a year while you are active and filing (in our state) to get your 26 weeks, you don't lose any of it. It does go pretty quick, though.

does anyone know whether you are still eligible for unemployment while starting up a company which is not making any profits in the first 3-4 months after deducting expenses ? I guess you wouldn't be lying if you stated that you had no income during those months, but are you considered a business 'owner' and hence not eligible to file ?

Your unemployment pay is determined week by week, hence why you have to report any income you make during a week. Whenever you get your severance pay, you'll have to report that as income for that particular week and you will not receive any unemployment pay. But you'll go right back to getting your normal unemployment check the week after your severance is paid.

I agree and from my personal experience in 2015, @zzk is correct. File for unemployment benefits online with the TWC on Day 1 after you have been terminated. The type of severance payment (single payment) that Chevron pays does not disqualify you.

From personal experience I can say you don't have to wait. The Chevron severance payout is not considered severance pay for the purposes of unemployment insurance because it is given as compensation for an agreement not to sue and because Chevron has no vested severance benefit (i.e. they decide on a case by case basis, it's not part of your employment contract or benefit package).

TWC is kinda vague on this and require you to report severance so they can determine if you are eligible

Severance Pay

Severance pay is a sum of money that an employee is eligible to receive upon separation. Employers may have a company policy to pay severance pay.

You must report any severance pay to TWC when you apply for benefits or by calling a Tele-Center at 800-939-6631. Under Texas law, you cannot receive benefits while you are receiving certain types of severance pay. We will mail you a decision on whether your severance pay affects your unemployment benefits.

Wages Paid Instead of Notice of Layoff

Wages paid instead of notice of layoff are payments an employer makes to an employee who is involuntarily separated without receiving prior notice.

You must report any wages paid instead of notice of layoff to TWC when you apply for benefits or by calling a Tele-Center at 800-939-6631. Under Texas law, you cannot receive benefits while you are receiving wages paid instead of advance notice of layoff. We will mail you a decision on whether your wages paid instead of notice of layoff affect your unemployment benefits.
