Vacation Paid after Retirement

I am an exempt manager and I get 28 days PTO per year. By July, I will have earned only 17 of those days, leaving 11 days "unearned". If I take all 28 days by June 30th, then retire in July, do I need to pay back the 11 days I have not yet earned?

Based on HR OneStop policy -- "If the employee has already taken more PTO than he or she will have earned at the time of termination, the employee cannot take any additional PTO, nor will the employee be paid out for any additional PTO."

Based on that, it looks like I do not, but I was wondering if anyone had an experience with this yourself?

I actually checked with HR before I retired, and they said if I took all of my vacation before I retired and some of it was not accrued yet, I did NOT have to pay it back. So, I took every last hour of it. I also took every hour of the care giver time too! Retired management Nov 2021.

I'd say shut up cause they'll change the policy when people 'abuse it'
but it literally says this in the policy.

a few people have already given the correct answer, but since so many people are posting their ignorance, i'll say it as well

  1. once you give notice, you dont get to use vacation that hasn't accrued.
  2. if you dont use it, you only get paid out what you accrued
  3. if you do use it all, unlike other companies they dont take it out of your last check.

Use your paid care days as well as vacation. No you don't pay them back if you haven't earned the vacation days

Glad I have a union contract. We get paid out the entire year of vacation ever if we retire the first day of the new vacation year.

Days aren't earned if you're exempt. that was only ever a thing when you were non-exempt. You start the year with all your vacation days, full stop.

Something else to consider:

I retired the end of December of 2020. I only took off 5 days the whole year and cashed in the unused vacation. I think it was around $10k. I figured I would be on vacation the rest of my life after 2020, so I could handle only taking off 5 days for the year.

If you are retiring then you shouldn’t worry about 11 days one way or the other, take them. Majority of employees have given way beyond 11 days extra work over the years by working through lunches, breaks, weekends, late nights etc…on calls, outages, meetings, you name it. I wouldn’t feel a bit guilty or unethical to take them.

Take all of the days ...they haven't asked for them back in the past. Think about it this way, Stankey stole a weeks vacation from us a few years ago that we had earned for working there for 20+ years. Call is is even! You actually should get two extra weeks since when they stole the vacation from us. Total Indian givers.

If you use them all make sure you have the extra days past when you hit mod 75 just in case so it doesn't effect your mod 75 date.

I retired a few years ago in October mod 75 and used all my vacation that was allowed for the full year. I've heard people retired in July and used the full year also. They never asked for anything back but who knows what they would do now. I would just use them if I was you. Good Luck!

I contacted HR a couple of days ago about the same exact question and they helped me figure out how many days I will earn thru my last month.

I proceeded to ask them the question if they will charge my severance or last paycheck if I go over the earned vacation days and she said they do NOT charge/collect if you go over and that is up to your manager to ensure that you do not exceed the vacation days that you "earned" thru the last month of employment.

Don’t record your days off in INFOR, but also don’t work between now and layoff. That way you get paid out and also get time off.
