Delivery during layoff

I supplement income with driving for Uber eats. If laid off, can I still do deliveries during an assumed non working notice period? Just trying to plan for worst case scenario

not that they would be helpful but have you tried contacting HR? I know you need to get pre-approval for taking a 2nd job to ensure no conflict of interest and would think as long as you have that approval before going into your non-work period you'd probably be OK, but I'm not HR so what do I know.

OP here. Unfortunately my state doesn’t allow unemployment if you’re getting anything at all, even then they cap it at about $200-$220 a week. I only deliver when my kids are in school so I didn’t do much over the summer. Wanted to get back into it but not if it means I’d lose severance if the time came for me. Im almost certain it is.

How do you get a non working notice period? I've only seen 30 and working notice periods.

Also, a golden nugget for you depending on your state. You can continue to do your side hustle (uber eats), collect severance, and collect unemployment all at the same time. The key is, you need to report your 'net' income to the state/unemployment officr for uber. That is income after mileage deductions ect. If you've been doing uber, you should know you're not paying taxes anyway if you're doing it right.

Be aware that income earned from “side job” may be deducted from your unemployment benefits, this varies by state but something you should be aware of/investigate for your own case.

You may not take another job during your notice period, working it's a working notice or not. Technically, if you do so you're quitting your job and lose both your remaining notice period salary as well as your severance. You can do whatever the he-l you want after your notice period is up.

They are not going to call you back in during that period. The first thing they will ask is for your equipment, badge, etc. back.

If your concern is that you will be called back into work or needed urgently that is very unlikely. Maybe they'd ask for some info they forgot to get from you (where did you put the key to your drawer, etc.), but nobody is expecting your to wait by the phone for 60 days in case they need you at the drop of a hat to come back to work - you were displaced and they planned for it.

If your concern is that you are somehow "not allowed" to moonlight in a non-financinal services side hustle in a way that is not a conflict of interests (like the gigs described) I think you'll be fine - consult the employee manual about 2nd jobs and follow those rules. If you were already doing this work because wells are a sh---y employer, and you still need this income then you will still need this income on your WARN period - not sure how they could compel you not to do these jobs.

Also, how would they know? I have heard of people on their WARN period starting new full time jobs.

There are probably ways they could figure it out, but I think they word the termination guidance to hint that you should do the "right thing" and tell them to stop your WARN leave and forfeit your salary continuation leave.

How would that call go?
"Hi, sh---y employer that nickel-and-dimed me so hard that I had to pick up another job, before you shipped my job to India and kicked me to the curb to fend for myself and my family. Yeah, it's me again - please stop paying me WARN leave, cut of my benefits, and pocket my Salary Continuation leave so Charlie can buy another guitar". Fu-k these guys!

You can have side income as long as you start before your 60 day notice date! When laid off last year i was going to work at Starbucks during my notice period (holiday season) but HR confirmed this would void my agreement. If I had started the side job even one day prior to the 60 day notice it would have been allowed. You can do whatever you want once the notice period ends and severance period has started.

I was wondering the same, I deliver for DoorDash. Hopefully someone knows the answer. I imagine it would be a similar situation for someone who has a part-time job, I would hope that they would still be able to do that.
