Hypothetical lawsuit and outcome

If a lawsuit were to happen against JS and the company for age discrimination, what would be our outcome?

  1. We get to stay and keep working without relocating to Dallas?
  2. We get a settlement but only after we left the company?
  3. Same as #2 but we are still with the company?
  4. The settlement could be significant? Or not any different than severance? Or not worth sticking around?

Im 50 years and part of the RTO forced to move to dallas. I have a job offer and now I’m wondering if I should go ahead and leave and never look back or stay to see how this plays out. It must be serious enough for Santone to suddenly depart

I for sure was laid off in
March due to my age. I documented a year of my treatment leading up to my forced retirement. But I signed the arbitration agreement because attorneys said I had a good case, nut it could take two years. I needed the severance so I could keep my house.
Heck, even had a manager who gave me an age-defying serum as my Christmas present. Would love to know what Stankey said.

When you tell a law firm which company you're currently employed at and why you want to file a law suit, they immediately tell you they don't see any laws broken because they know their firm will be tied up in court for years and years by AT&T. Believe me, t went through this and could not find a firm to represent me against ATT. Good luck if you're seriously considering a class action suit!

The CEO has not and does not have a viable business strategy. His previous strategies consisted of buying companies and incurring huge debt, selling off those businesses at a loss. Then his strategy is to get rid of the huge debt burden is to eliminate the very people whose hard work and successes game him the cash flow which allowed him to make such bad decisions. Removing people over 40 will decrease medical and pension costs and have the business units ripe for purchase. A

Considering that a lawsuit will prevent those of us still employed, yet already told to move, from getting the severance money, if we are part of the suit, I think the only option is that someone needs to leak this to the press. Stankey’s mouth will do the work of driving this company into the ground. The press must know that everything is a game to him, including people’s lives. Young people do not support a company who treats employees like cr-p. They will just pass over this cr-p. My job can’t be saved but I can support our CEOs views being made public.

I am not sure I understand what people that are still working here, are talking about a class action and potential settlement $$ for age discrimination..... AS YOU ARE STILL WORKING HERE.

Look, I heard the comments and was one of the first to post about it here. I couldn't believe what I heard. That said, I am a 50 something long tenured employee still working here.

You're not going to be part of any class action as someone still working here. Hard to fathom how some seem confused by that.

That said, I would say anyone of that vintage that has been or will be laid off may have a claim.

I believe the company has tried to be careful about spreading the age demo around when it comes to layoff...that said I still know of a TON of people over the age of 40 that got hit the last few years. In fact, literally ALL of them (in my case anyway).

I think given the reckless and boneheaded comments in public the other day, it may force them to be even more careful about their layoffs numbers for those over the age 40. Which may be a good thing for those just trying to hang on another couple years.

Google it! Search for ‘AT&T Age Discrimination’. Very recently a woman was awarded $2Million in her suit. And it’s been in the news before many times. It doesn’t seem to have any real effect, like throwing pebbles at fifty foot monster.

The best you could hope for is that Stankey and other C-levels are forced to retire early with their golden parachutes and that the people replacing them choose not to enforce the policies of the previous regime.

"Santone" wouldn't be much involved in setting headcount.

Headcount numbers are created within business units based on budgets developed by finance. Budgets flow down from the top to each unit and there are limited negotiations at various levels. The result is a headcount target for a given time period.

Trust me the legal department ensures the risk for age descrimination lawsuits is reduced to nil. When I got surplused they sent me 20 pages of every person laid off and their age.

You shouldn't make important life decisions based on hopes for a possible lawsuit. It takes years to settle these things. I would be surprised if it would be more than a normal severance.

If its a class action in 3 years you get $10 and the lawyers take the rest. If you get laid off you can sue for age discrimination based on what CEO said. They are in panic so best bet would be to not sign NDA unless they dish out a really great severance.
If you are remote and have another job offer you can accept the new one and dont tell ATT. Do minimal work waiting for the layoff pkg.
