Thread regarding Oracle Corp. layoffs

It is far from over, more layoffs coming. But, you might be able to do something

We wont know until the 10Q comes out in September if the true number set aside for severance packages really is 1 Billion. But, if it is $1Billion I don't think enough people were let go.

Traditionally the big layoffs come in June. Not sure why they changed that to August, but they did have a reason. People were asking about warn notifications. As I posted earlier Covid-19 suspended the need to file warn notices.

On June 15 2022, a federal appellate court ruled that the COVID-19 pandemic is not a natural disaster that would relieve employers of their duty to give adequate warning before mass layoffs. In Easom v. US Well Services, former employees filed a class-action lawsuit after the company laid them off in 2020 without giving 60-days' notice.
The federal Worker Adjustment and Retraining Notification Act (WARN Act) requires employers with 100 or more full-time workers to provide written notice at least 60 days before implementing a plant closing or mass layoff, unless the layoff is a direct result of a natural disaster or unforeseeable business circumstances.
The court found that the COVID-19 pandemic did not qualify as a natural disaster because Congress did not include words like "disease," "pandemic" or "virus" in the statutory language of the WARN Act. The court did not address the extent to which the "unforeseeable business circumstances" exception to the notice rule is available for COVID-19-related layoffs.

But that did not stop companies from laying off workers. Before or after the court ruling. You might investigate and you may find the lack of a warn notice did impact you. Also if you did get a severance package as, I did a few years back, you have to sign something to the effect you wont speak poorly about Oracle for 1 year or sue them.

My advice: If your severance package is large be grateful and move on. Honestly my package was nice and I have no complaints. The job I got afterwards was awesome and I had a month to prepare and interview. You have to give credit where due and Oracle does treat long term employees quite generously with the severance packages.

But if you were a short timer just here for a few months or a year you might have an axe to grind and cause for seeking justice.

Yes, practice you kegels, relaxation breathing and grabbing your ankles. Then it won't hurt so much once it all starts up again.

If we pursue the WARN Act w/ lawyers, would this affect our severance?
