Can i Use my maternity leave prior to my last working date?

I'm due in March and have been impacted with these layoffs. My last working date is Dec 31st. I have severe complications and might go into labor prior to my last working date. Can i use my maternity leave if i go into labor or i wont be elegible because i won't be their employee after Dec 31st?

why all the downvotes? some good info here. You really should contact your HR business partner or the benefits office to find out your alternatives. All coverage normally afforded an employee is in effect until your termination date. After that your benefits are covered for your severance period (2 weeks per year of service capped at 35 weeks) at no cost to you. After that you can pay for Cobra out of pocket for up to a total of 18 months. If you have the baby after you terminate, there is no maternity leave as you aren't an employee.

You should go on short term disability asap. Then move over to maternity, leave, personal time, long term disability. You have many options.

If you live in California you might be able to. Otherwise you need to go to your doctor and asked to be put out on short term disability. Once you have the baby then you’ll be able to take advantage of maternity leave and they won’t be able to lay you off

Follow the advice of @pat especially if you are in California. The doctor can have you put on disability and then even if you are laid off you can maintain your "employee" benefits for 6 months. After that COBRA if you choose to do so although in California the Covered California is a more economical solution. Have a wonderful and healthy baby.

It wouldn't be maternity leave prior to the birth, it would just be short term disability if you need to go out on bedrest. If you have the baby before the end of the year, then yes, you should get the maternity benefit until the day of your termination. Best wishes and I hope your baby does not come that early.
