What can and can't employers legally require when it comes to COVID-19 vaccines?
As more companies continue to bring more people back into the office after more than a year of working from home, questions are being raised over what employers can and can't legally require when it comes to vaccinations.

FOX 9 spoke with Minneapolis employment attorney Greg Simpson of Meagher + Geer to get some answers.

Can employers require their workers to get vaccinated?
"If they are working on-site in the employer's facility, with some exceptions, employers can require those employees to be vaccinated for the safety of other employees," said Simpson.

Those exceptions need to be well documented and include sincerely held religious beliefs or a medical condition that would make it a burden to get the vaccine.

Can employers require proof of vaccination from employers?
Yes again, according to Simpson.

Companies can require proof from their workers, like a vaccine card, but it needs to be kept as a confidential medical record.

If an employee refuses to get vaccinated, can they be fired?
Yes, with the religious and medical exceptions previously noted. The U.S. Equal Employment Opportunity Commission enforces federal laws to prevent employment discrimination and recently issued guidance on the matter.

"Employers can require their employees to be vaccinated and fire them...if they don't get a vaccination," said Simpson.

As cases of the COVID-19 Delta variant rise as more workers head back into the office, Simpson tells FOX 9 he thinks we will see more and more companies start to require vaccinations for employees.

MN is CA lite. My Dr. said ADA protects you. Once you divulge you are not getting the vaccine for medical reasons they cannot ask for details. Did you not take your ADA training this month? Fearmongering and peer pressure doesn't work on wolves.

If schools can require proof of vaccination, I don't see why corporations cannot. "Corporations are people," after all.

No one has ever been required to take a non-FDA approved "vaccine". Not even government or healthcare workers. If they want to mandate a treatment, there's an FDA approval process and it exists for a good reason. We do NOT know what these treatments will do to us long term. It might ki-l millions, it could cause cancer, it might impact fertility, it could do all kinds of things, we have literally no idea. We hope that there's no long term effects, but we do not know and anyone claiming otherwise is lying. People keep talking about the liability if a non-vaccinated person infects someone in the office. That risk hasn't materialized with the employees that have been in-office the entire time, but if there are long term lethal side effects of these dr-gs and you force people get them? Billions and billions in lawsuits. You won't be able to sue big pharma, they've got a get out of jail free card from uncle sam, but you could sue your employer for forcing you get it, and you'd likely win so long as the treatment is experimental.

Watch.. complete speculation to follow those told to go back in September will be the vaccinated, with the unvaccinated being the second wave in October. That is why they want your status now. The Pfizer vaccine is expected to be fully approved by the FDA in under two months now.

Just in time to clear a major hurdle about requiring vaccinations when it is not fully approved. You don't have at least your first dose in with your second dose scheduled? Sorry, you are fired.

They are out to find any way they can to thin headcount. Those not vaccinated may be in the list of layoff targets. Don't give them that chance, unless you really value your freedom above a paycheck.

I agree that folks should get vaccinated, but forcing it in finance is a slippery slope. It's a no brainer for healthcare though
