I know of 2 people who have recently won very sizable age discrimination lawsuits against large publicly held companies who were in the midst of layoffs.

One had proof through emails from her manager which were unimaginably dumb on the manager’s part. Company also replaced her with a younger cheaper person with a different job title, but essentially the same job duties, which she was able to prove.

The other had years of high-rated reviews which suddenly dropped to low ratings, under a new full-of-himself younger manager, as well as corroborating testimony from co-workers.

So - if you’ve think you’ve got a real case and you have documentation to back it up don’t shy away from filing. These 2 people found a great deal of satisfaction in slapping back their former employers. They both say that was more fulfilling to them than the money.

They will simply either go to web search history or go to WARN notice posted.

If the ages of those let go were equally distributed, its tough to prove.
