A lawsuit accusing Wells Fargo of failing to pay call center employees for all hours worked is entitled to move forward as a certified collective action, although some of the plaintiffs must arbitrate their claims, a federal court in California said.

Call center workers were required to perform unpaid work before and after their shifts, including logging onto the company’s phone systems, completing customer service calls.

Getting nonexempt employees to work unpaid hours is Wells Fargo's dirty little secret. Just set the daily/weekly production goals a bit too high to achieve in a 40 hour week, then tell the employees no overtime is allowed. Period. Let fear of being fired add the extra pressure. Most employees will not be able to meet their goals within the 40 hours, so will work some time off the clock. This has been going on since Norwest was acquired.

Any employee in banking with any decent education becomes exempt from overtime the moment that they are viewed to be competent. Unpaid OT comes with the territory and is a sign that you have a career. It is up to you to develop your career and your salary will grow well beyond your clerical earnings if you simply try.

Anyone who works unpaid overtime without raising a stink is crazy. There are a lot of media types who would love to hear about that and a lot of lawyers who would love to sue for labor law violations.

So the employees ignored labor laws, violated company policy and falsified documents by intentionally entering inaccurate times in Time Tracker even though company policy says to do otherwise and compliance training echos that? I don't see this lawsuit going very far. Memo to anyone out there in this position: you can never be fired for accurately reporting your time worked. You can absolutely be fired for falsifying a company record / time sheet. Report your time correctly.

The contact center, particularly the CSBB one has been mismanaged for years. Incompetent leadership team who just whines and complains about everything vs stepping up, solving problems, managing risk, and obviously paying employees
