What happens to PTO if you are laid off?

Do they pay it out or is it gone?
Does it matter what state you live in?

Just be careful if you get a 60 day notice that carries you into 2021 you will need to use all but the 5 carryover days or lose them. They will then pay you for the 5 days in your first salary continuation check

Correct – accrued and not used. But in some states like CA, ALL of it is paid out.

READ the Employee Handbook.

It's based on how PTO is defined legally by each state. Some consider compensation/wages, which is why in CA you can rollover all unused PTO to new year.

Legally they have to payout any accrued and not used.

Paid out. Holidays are not, so don’t rack up floating holidays.

you get paid out depending upon how much you have accrued at the time of separation...

Because PTO is earned (you earn a number of PTO hours every pay period), WF will pay it out. If WF had open PTO, or if they simply gave everyone all PTO days, it would not be paid out. The big difference is that PTO at WF is earned.

Definitely depends on the state you live in.

Typically, it's use it or lose it.

However, In some states, like CA, PTO is considered compensation/wages so it must be paid out.

Please read the Employee Handbook to be fully informed.
