I hope HR is ready to defend an EEOC investigation that is going to kick off - people who filed EEOC retaliation complaints are not being moved into control opportunities when they can prove they are more than highly qualified, but are being discriminated against and denied the opportunity because they filed with the EEOC.

How do layoffs have anything to do with whether or not someone is highly qualified?
If it's about cost-cutting, having someone qualified versus highly qualified can save money. There's no discrimination involved at all.
