If most of your department is over 50 and get laid off, keep younger workers or workers from India to replace American workers, refuse the package if you can and file a class action lawsuit. Now I know the chance of this happening, less than 10%. But if you have the means and feel you are a victim of age discrimination, it might be something. Oracle has staggered these RIFs in such a fashion, so they don't have to file WARN, face age discrimination and so on. There might be something there, given how incompetent Oracle HR Nazi's are. What is this "retirement" you speak of? Oracle does not have a pension plan, just a paltry 3% 401K match.

Sure it does, those who get laid off a day or whatever from retirement is getting a backhand bonus from O. I knew a few who were absolutely giddy to get the package. They had a grin on their face as they walked out.
Lawyers have nothing to do with it. It's a formula HR is using to determine how many people are needed to go to sustaining mode. Lawyers will prob be RIF'd too.
These are total haircuts. It does not matter if you are a day away from retirement, a recently hired NCG, or someone in between. It does not matter of you are in RWS, SCA, SHA, BGL, etc. There is no mercy. It is bloody.
Go to court and be fired in the next round ...
80% of my team gone, including Indians, Chinese, Caucasian, citizens as well as H1-B, over 50 as well as fresh grads, men as well as women. Another team, 90% impacted. Same deal: young/old, male/female, manager/engineer, all races and national origins. Seems to me they're just decimating the entire Sun/Systems group without any regard to whom they are crushing underfoot.

There's no dumping on Asia Indians, fact is there is favoritism toward hiring people of Indian descent, check out the lawsuit filed by the US Gov against Oracle back in January for Indian managers nepotism. These are facts. H1B screw Americans over. May the force screw you.

When they had layoffs in our SPARC group back in January they RIF'ed mostly over 50, but they also RIF'ed one of the college hires in our group. Trust me, the Oracle lawyers have layoffs down to an art form. They will be sure to throw a few token millennials in the RIF mix to avoid a lawsuit. In fact I would be surprised if these b@stards deliberately over hired the college kids simply to RIF them along with the rest of us and thus avoid a lawsuit.
