Do the Math - 740 = 7% of WHQ

"Nike plans to lay off 740 employees at its world headquarters in Beaverton by June 28, according to a notice the footwear and apparel giant sent to state officials."

This is roughly 1 in 14 who will "sacrifice everything" because they "believed in something".

You don't need the notice from Nike to understand the scope, it takes 15 minutes to find the statute and read it. It's very simple: with 500 or more people at a SITE (emphasis) involuntarily terminated in 90 days = obligation in this case to file for phase 1 + 2 + any others in the period.

People seem to be glossing over payroll termination date versus when conversations happen. Most end dates are in May for phase 1 except H1B. WARN is not a clever rule and has been skirted by payroll timing trickery for its entire existence. Delaying notice helps companies like Nike that don't have an actual RIF plan figure out their layoff strategy after it's partly underway.

The max penalties are also peanuts and lower court action doesnt go very far, this is a checklist item for a company like Nike.

Keep in mind EVERY word in the WARN notice was scrutinized over and over by Nike Leadership and Legal team since December. I can't bold/highlight, but i did take liberty to put in CAPS, the 2 words that include the February "exits"......

"As a result of a second phase of impacts, which will take effect by June 28, 2024, approximately 740 employees at WHQ will have been impacted by this and the RECENT PRIOR permanent reduction of workforce. "

The lack of reading comprehension kind of scares me knowing these are people that I'm working with, though it does explain a lot. There is a lot more to the WARN than just rolling 90 days as multiple people have quoted as well. You can't get around the WARN notice by splitting your layoff across multiple 90 day periods to stay under the threshold. The people who wrote the rules were not id--ts. If it can be proven that the layoffs were part of the same overall layoff strategy, they have to be included even from the previous 90 day window. While yes, a company could lie about this, do you really think Nike would risk a lawsuit over something as unimportant to the greater scheme of things as a WARN notice.

There’s nothing in warm that says this includes past numbers. The article quoted also says this will go through mid June. Nike came out with a statement of 1600, so it would be logical to think 740 is round 2, oregon only.

No need to quote to Oregon Warn anyone laid off in different states and countries. There also isn’t a legal requirement for the Feb or Dec layoffs as they were under 500 with 60 day notice.

90 days after the Feb round will be well before the end date for those announced next week so again, feb doesn’t need to be included in this WARN.

480 was the total for all of Nike last round. Anyone not working out of WHQ would need to be subtracted from that 480 figure, and I don't think anyone knows what that number is.

Math by @1hnh+1s7oYrpx is way off.
Its only taking into account the salary. You have to include the corporate savings due to 401k match, medical, dental, vision, insurance, phone subsidy, equipment, software licenses, the list goes on and on. Usually, thats 1.5x the salary.

Plus all of the ETWs, who were discontinued or not renewed quietly at the end of last year, or as a result of the changes happening next week. Definitely higher than 10%+ total. It will be felt.

7% is a LOT, and it doesn't even include the folks who resigned because of demoralizing leadership. Can't help but wonder what the true attrition numbers at WHQ look like.

For those wondering, WARN is the Worker Adjustment and Retraining Notification act. It helps ensure advance notice in cases of qualified plant closings and mass layoffs.

@1tpf+1s7oYrpx wasn’t referring to the rule, was referring to the total number of people being laid off is more than 700 or whatever.

No one cares about WARN especially if it’s only quoting part of what’s actually happening.

Also end date timing of the last round will be in the 90 day window since next week also gets 60 days before they count.

The min 60 day notice period is irrelevant here except for timing this submission. WARN aggregates a 90 day period to meet its headcount threshold. 90 days prior to the stated termination date of phase 2 includes phase 1 payroll end dates and whatever other small aftershocks but not all the way back to early winter.

If everyone just read the rule instead of guessing there would be no ambiguity, its not very complex

If you read the actual warn notice and not the articles floating around is clarifies that it is a total of 740 between first round and this round.
