Legal Review of Agreement and Release

Has anybody who's been displaced had a lawyer review the 'Agreement and Release of Claims' document before signing it? Have any concerns or recommendations been given?

Look closely any any "Attorney Fee" sections or clauses: Refuse to pay any attorney fees. Usually, there's some boilerplate that you have to pay any attorney fees. Strike that from that agreement, that's about the only thing that's negotiable, at least by reasonable companies.

Legal review is generally not too expensive. I imagine less than 1000. Too much for you? Then see what others wrote below.

My husband is an attorney and said he had no concerns. Was very standard but there was no room to negotiate- they very much made it "sign and get severance or don't and don't".

@dwf+1sF0hLdS Reason is in packet, mine said “as a result of an assessment of our business and staffing needs your position will be affected by either a position of elimination or substantial position change as defined by the Wells Fargo and Company severance plan”

Do they give the reason for displacement? I mean what is typically mentioned in the assessment? I am slated for 5/28 displacement.. and I do not have an attorney.. so trying to see what all I need to be better prepared...

I did. All my questions were addressed, including confirmation that the disparagement clause does not include talking about things that actually happened. While signing waives your right to sue directly, you still have other avenues to pursue wrongdoing. Just don't share nonpublic documentation. Let attorneys gather information through discovery if you pursue an indirect action.

Since you have to sign it to get your severance it does seem like you have no choice. Sounds a little unfair. You should be entitled to your severance but if they selected you based on what you think unfair assessment you should be able to sue.

Why wouldn't you have a lawyer review it? Who knows what shady stuff WF sneaks in there about arbitration, etc.
