I wonder if they can dig into your doctors appointments. Would that count as HIPAA violation?
Not paying IC for 2024 because I’ve resigned this year…. What about the hardwork put last year… furthermore making unlawful deductions and breaching privacy
They technically can track personal devices if you’ve got company apps. Privacy breaches in nz as well
Circumventing the "oxley" rule that requires all business activities to be made on company owned devices. BYOD is illegal - texts, calls, outlook, teams, etc. have to be on company owned!!. It's that simple folks. When Fiserv got a banking license, the world changed and our compliance department really dropped the ball. Enough said.
As others have pointed out, violating the spirit of FMLA/ADA laws, while not technically the letter of the law. They k ow they're in the wrong, but they do t care because they're well protected by an army of attorneys.
The issue of not paying bills is another good one. I know of a few vendors that we haven't paid in over 2 years despite making them jump through constant paperwork hoops.
Having exempt employees clock their time. Have to make up time for appointments or track it now in workday with explanation as to why you were gone. Counting breaks against people in Sapience.
Company is well protected so doesn’t care. Majority of work they do is illegal but backed my lawyers

Getting people to work extra hours based off on a formula which calculated millions more profit will be generated at the expense of employee sanity and health

Offering unlimited vacation time and then putting limits on what you can actually use.
Fair Labor Standards Act states the following regarding “Unofficial Policies of Clocking in/out” Requiring Exempt employees to clock in and out (Badge Swipes) can imply that their pay is based on hours worked, not fixed salary.
@bf+1jhm297g9 does have a point. My experience is that fiserv walks right up to the line, tip toes on it like it's a tight-rope, and doesn't often teeter-totter over it. Which is to say they KNOW they're in the wrong, but with so many attorneys at the top they tend to CYA themselves pretty well. They're quite proud of themselves for it and I'm sure extra insurance has been provided to them for potential injuries patting themselves on the back. After all, they ARE masters of the universe ruling over us plebes. At least in their heads.
They are doing nothing wrong by tracking. Thats is business standard
Anyone looking for a legal angle should file a claim with the Department of Labor Wage and Hour or hire an attorney for excessive overtime or reclassification of a position from exempt to non-exempt status. If your position doesn’t meet the standards of exempt they will be required to pay all back overtime pay. Although exempt employees are not entitled to overtime pay companies cannot abuse that policy by forcing repetitive overtime without compensation or proper rest time. Look up the Wage and Hour policy. This is what the company is violating and will get them legally into trouble and will force change

Fiserv has the highest standards and follows all laws to the letter. You whiners have not realized how blessed you truly are to work for Fiserv. We will jave a town hall on this subject soon. They breach employment law
Umm they pay people for doing things like bullying, s-xual harassment. Basically if you engage in misconducts the company will engage a lawyer and give hush money especially if you fight back. Leaving the victim still working in tears because the abuser is rewarded. Happening in my team right now and as the manager I have no say given Australia HR rules it all

Laying staff off for no reason. One member in my team was meant to be layed off but then HR advised against it. But they still had to lay someone else off so they randomly added a guy
If you have been laid off by fiserv and hold $2000 in stock for 120 days. Write a shareholder request that these things are investigated. All shareholders of the company will be notified to vote on it and if they vote for (or against), likely for the company is forced to present the details and information to the shareholders. It's required by the sec.
Not giving lunch breaks and forcing staff to spend their own money on company related stuff
Basically all of that along with breaching client contracts.
