@15h speculation is useless. having a partial personal agenda is useless. the lawyers work on this kind of stuff in a completely different way... that is a lesson for everybody here.

  1. stay disciplined and don't run your mouth
  2. if you're a senior exec running your mouth you su-k beyond belief and you don't belong anywhere near a billion dollar company
  3. chill and do your effing job unless you're a lawyer

my perception is that the deal fell through because of lack of discipline in keeping things confidential. which makes me think some people in exec positions were either incompetent or had vested interest in torpedoing the deal.

Neri & co were overconfident of closing the deal last October. The final decision lies with the judge, unless both companies settle out of court with the DOJ which seems highly unlikely. It's not what Neri wants but what the court decides.

Neri might even get fired if Elliot has its way.
