Class action lawsuit on product that doesn’t ship

Class action lawsuit coming soon to Michael Dells desk for review. Count up all your revenue that is Pending Production….we have 3 months to get ever shipped out to hit our attainment to make our commission.. if we don’t hit 60%, then we owe back to Dell…
Be on top of factories and team to build and ship your product out ASAP!!! That 60% is what needs to SHIP!

I’m curious how much backlog will actually ship that will count towards the 60%.

Who cares about the 100% when 60% is what were actually needing..

As far as I know, France hasn't even received the new SCP communication so far (at least that's what we heard from French colleagues last week).

@ed
If you cannot repay it with commissions (because you make no commission for two Q in a row) and you are laid off, or decide to leave, then it's deducted from your base salary.
It has already happened in the past to some people in our country (draws used to exist, they were just very easy to pay back): they were let go during a mass layoff cycle and they had a very low attainment in that Q, so the M1 draw was deducted from the final salary.

From what I understand, you won't have to pay it back. It will just be deducted from your commission earnings from Q2 or Q3/Q4.

@d1Yeah, it’s France — land of baguettes and strikes, God bless. They’ll politely inform their manager they don’t recognize that SCP nonsense, and then the unions and labor lawyers will happily take it from there.

What counties are allowing opt out? Not US

@c8
In the deck they used to present the new SCP in EMEA, the part about draws hand a note in bold stating "no opt-out possible".
For what it can count, a couple of dozens people in my country have already mandated a lawyer to be represented in rejecting the new conditions, since the attorney confirms what they are pushing is not compliant with local labour regulations.
Local management has also requested a formal opinion to Dell's legal covering our region, who confirmed this was pushed from US without prior consulting them to see if it was compliant.

@c8 I opted out on day 1. No way am I going to put myself in a position where could end up owing my employer money. That's just foolhardy.

Or just sandbag until q2. Have it backfire to the street and improve your chance to make money. Two can play this game

It’s actually 80% if you don’t want to pay back the draw.
