Thread regarding Oracle Corp. layoffs

Age discrimination

Too many old-timers have been hit. I wonder if there's grounds for an age discrimination suit.

@a6 I thought protected classes were out the window if a layoff impacts 10% or more?

You can try if you think you can win, but you'd likely be forfeiting any severance you'd get. I believe signing the severance agreement would include waiving any right to sue for age discrimination.

These layoffs are clearly hitting more experienced workers hard. Sure, some are worn out, but lots are top-notch. Gotta pay for those AI chips somehow.

The OWBPA protects employees over 40 by ensuring they have enough time and information to understand their rights when waiving ADEA claims, especially when presented with a severance agreement.

OWBPA (over 40):Adequate Consideration Period: Employees must have at least 21 days to review the agreement.
Group Termination Disclosures: For terminations involving a group of two or more employees, the consideration period increases to 45 days.
Revocation Period: Employees have 7 days after signing the agreement to revoke it, and the agreement only becomes effective after this period expires.

The job titles of those terminated and those who are not.

Oracle does not have one single product that is popular with the young generation. Oracle is a old-timer company with old-timer products. It’s just about numbers.

Look up federal Older Workers Benefit Protection Act (OWBPA)
