Has anyone got the layoff call during any sort of medical leave or maternity leave? After working with wells Fargo for 6.5 years, On December 5th, I received the call from my manager and I was the only banker at my Florida location to be let go at this time. What are your thoughts on the paper work? I have never experienced something like this and just wondering if anyone is in a similar situation..

I was let go one day after returning from FMLA. 60 days notice plus 10 weeks severance, as long as I waive my rights to sue.
I was on personal leave and got laid off. Every single rep from displacement stated I qualified for salary continuation. I recieved a call that I was misinformed. I have been an employee for a long time.
So does this override the Maternity leave? Meaning does the 2 months start while on leave or after?
I know someone this has happened to. They are laying off people on leave.
Enough of the Attorney talk...WF is not violating any labor laws. WF is giving 60 days pay on top of what you will get for time served. Shake it off and get your resume out there. Change is good!
I'm on leave as well and still have not received the emailed packet yet. Still waiting
Parental leave is 16 weeks not 14.
You also are "employed " for 60 days before the official severance kicks in.

FMLA is 12 weeks of job protection for parents, family care, paid and/or unpaid
WF parental leave is 14 weeks, but it’s a benefit not legal protection

I got laid off a month and a half after i got back fr maternity leave (im fr florida too, only one laid off fr my district). S—s but im thankful for the 16weeks paid leave. Now im worried about finding a job comes february (after the notice period) its hard to enjoy this bonding time with my baby when im thinking if any bank will hire me knowing i came from a “tainted” company.

Consulting an attorney is not the same as saying 'sue' them. you should always consult with an attorney as they are best at interpreting appropriate law. just like you don't prescribe yourself medication, you should not guess as to what is legal or not.
Attorneys are there to help you understand applicable law, not just to sue the pants off people or corporations.
@OP+18nlOcCe , As previously posted, FMLA does not exempt you wholly and completely from being laid off. Feel free to consult an attorney. There are always free consultations out there but you had better have your facts lined up and be clear and concise and leave out the emotional BS. This will ensure you get the most accurate free advice. If you are not clear with the attorney you WILL end up spending money just be to left in the wind later. If you make a claim that "you were the only banker laid off" you had better have names and timestamps to back that information up. Remember, if true that you were the only one of your position let go at your branch that doesn't mean there weren't other nearby branches affected in the same way. You can be sure WF Legal was all over your lay off.

Having a baby doesn't give you magical protection unless it could be proven they specifically laid you off because you were on maternity leave, which likely has zero chance of being proven. I've been on the other end of something related, where a direct report went on medical leave on and off for what seemed like years. Company had to pay this guy's belly ache for basically years and could do nothing about it. My view is if you get cut take the money and run, find another bank to land at and move on, don't get hung up on this place.
Same thing happened to my wife at another employer a few years back. FMLA doesn’t mean you cannot be laid off.

Layoff during maternity leave sounds like a violation of FMLA. Maybe you should consult an attorney before signing the severance paperwork.
