I heard that we may have reorganization on the IT side and that some groups will be merged. This will impact managers and staff as well. I am not saying BD will have layoffs in 2015 but it looks like a reorg is almost certain. If that happens, make sure you are covered, work hard, contribute and of course, pray.

Since the NDA is the biggest weapon here, secrecy has been how this scam has been able to continue, thru payoffs and extortion (if you want your last paycheck, or if you want your severance, you better keep your mouth shut. The weapon for this is exposure. They know how scary it is for workers to stand up to this since they have the power and will essentially black ball you in the industry and keep your severance. If you are older pretty much all of the companies are discriminating against age and likely will not hire you anyway. Being forced into retirement is no joke. Everyone gets older and we should be compensated for all of the expertise and wisdom we have accumulated not targeted. Not to mention the fact that this scam will eventually bring America to its knees when there are no jobs for American workers.
Yes, the open position is all for show. At this beginning of this year, I applied for an opening outside of infrastructure that I am 100% qualified, my boss came to me and beg me to stop applying. Later on, I found out BD applied H1B for someone for this position. Now, I am targeted for layoff, I was sold out from both of boss and BD.
And don't bother applying for open positions, if there are any left that they haven't put on hold. You will not be formally interviewed because it's all for show, as read in the many articles about the h1b scam, they only post these positions as cover up. Funny how people were encouraged to be proactive and seek theses opportunities by our cio at the town hall.
To the people who got the “Associate Briefing” invitation, I am almost 100% sure BD wants you to flip your badge and join the Indian outsourcer. Please be united and say no to them. We need to do the right thing and make sure this is a failed project. BD needs to learn a lesson here.
Has anyone taken the h1b issue to Facebook or any social media?
Many of us had received an invitation for an "associate briefing" session; we all believe whoever got the invitation is targeted for the layoff. I don’t know what BD will say in this briefing, but If they frighten or promise you anything, ask them put it on writing. We are dealing with very bad people here and need to be careful...... Before you go the briefing, make sure you read the latest severance policies:
..... http://bdone.bdx.com/ShowResource.aspx?IDX=78731&file=US_Severance_Policy_Exception_March_2015.pdf
..... and .....
http://bdone.bdx.com/ShowResource.aspx?IDX=11935&file=SeverancePolicy.pdf
..... Remember, we all employed by free will and do not need to accept anything, If BD ask me to sign an NDA to hear what they will offer me, I will not sign it. If BD ask me to interview with the outsourcing firm, I will tell them no. if BD lay me off on the spot, it is doing me a favor, I will get extra 60 days of pay based on the Federal WARN law plus the severance package described in the severance policy.
..... Good luck to everybody.
I think they have been using the cya method for a long time and will use the consultants that have been at bd for years to train the outsourcers, along with maybe mixing in a few higher skilled outsourcers to cover up what they are doing, which is replacing skilled bd employees with unskilled, cheaper labor. They got rid of skilled, core bd employees in september in order to create positions that would need to be filled and will fill them with younger, cheaper outsourcers.
Good for you, that is the only way to screw them over. If we all quit before the knowledge transfer process then all hell will break loose .
It is 100% illegal to hold anybody's paycheck. Fill a complain to the labor department today.
Good luck to you at your new job. Thank you for taking a stand for th e rest of us.
I just gave my notice this morning, got another job. They immediately came to me with a NDA and told me I could not talk about the outsourcing publicly if I wanted to get my last paycheck. I told them that they can keep it and walked out the door.
I still don't know who the service provider is but I will tell you that if you are not a VP or higher and are located in Franklin Lakes, you are out unless you want to take a 25% pay cut at a start with the service provider. They are going to replace everyone with H1B visa folks who are younger and cheaper than you.
They are also hedging their bets that no one will stop the outsourcing because there are "core functions" missing from the IT organization. What they don't want the public, the DOJ and DOL to know is that these "core functions" such as server administrators and what not are missing because they laid them off in September.
Yeah, they learned the lessons from the Disney debacle and they are trying to win it this time.
This week we should know more. Good luck everyone!
Individuals are starting to rally around employment lawyers. Ask around and know your rights! I can tell you the poor starving lawyers are quite hungry for litigation given the recent HCL events and immigration attention in the debates.
This is the attitude you can expect if you badge-flip:
Vineet Nayar, chief executive of HCL Technologies, says that American tech grads are "unemployable."

Search "severance policy - exception" on BDone, you will find the policy for this layoff.
This video bring me to tear, especially with the coming layoff that impact so many families. Take a look yourself https://www.youtube.com/watch?v=3bdm4NBYxII
One thing about the “General Release”, I am sure BD will try to add extra wording in this paper to require you to train your replacement and act in good behavior before you leave BD on Jan/Feb/March. You need to watch out because it is subject to interpretation on whether you had successfully train the H1B or acted in good behavior. If these additional requirements are on the paper, you need to ask them to put everything on paper to define what the success criteria are. Good luck and have a good fight.
It sounds like this package is different from the existing "Severance Policy” on BDone website. The basic severance is one week for one year of service. And if you are willing to sign the “General Release”, you can get an additional one week per year of service. If BD let you go on Monday, BD also need to pay you another 60 days of pay based on NJ law. But if BD wants you to leave on Jan, they don’t have to pay you the 60 days of pay.
BD also need to pay you all your un-used vacation days, if BD wants you to left on Jan, you are entitle to get pay on all your vacation days and the bonus.
It depends on how many years you work for BD, you might be a lot better off with the existing severance policy. I encourage everyone download the severance policy to calculate what is the best number for you.
The caveat is they will only give you the sev pkg. If you sign an ND so you can't sue.
Severance is 12 weeks and then 1 week per year over 8 years of service. That's the basic package for everyone below a supervisor.
I thought the severence was one wk per year of svc.
Anybody know what kind of package BD is offering? I don't want to walk into a surprise on Monday when I see my walking paper.

Remember the post about BD was told the transition plan is unrealistic? Signing the contract is the easy part, actually getting things transition is the challenge. With all the resentment had built up, BD suddenly found out the reality is nobody will transfer to the out sourcing firm, key technical staff will bail out within a month or two, even for the people who stay for the package, they will not cooperate to the H1B replacements and might even sue…….

The contract has been signed a week now and BD still doesn't tell us anything. Bunch of lying cowards.
Anonymous174336, nice poem...brought a tear to my eye. You should publish that.
First they came for help desk, and I did not speak out—
Because I was not in help desk..
Then they came for IT, and I did not speak out—
Because I was not in IT..
Then they came for R&D, and I did not speak out—
Because I was not in R&D.
Then they came for me—and there was no one left to speak for me.

It doesnt matter if you are a quality employee with skills who works hard instead of just doing enough to get by.They will target older employees 40, 50, 60 that have been there for a while and make a higher income and replace them. Especially if you or a family member had the unfortunate need to use your healthcare due to a disease that requires a lot of treatment and/or follow up. You're a throw away.
LOL. All these managers who had worked on this outsourcing deal were required to sign a NDA. At first, they were happy and thought their job was safe. But now, it turns out nobody is safe. This is why you could not find a single manager is willing to say anything positive. Keeping their mouth shut is the best they could do.
WOW, just wow. "Once the contract is signed we will reveal more details."
Really? Not hearing a peep from anyone in leadership. What a bunch of cowards.
Are the board of directors know what is going on? Anybody who have half a brain can tell this out sourcing deal will hurt BD financially and it's reputation, Are these board directors getting kickbacks? I wish there is a way to send them letters and remind them they are on the payroll of BD and not some firms in foreign countries

Someone talked about forming an IT union. Does anyone know of an existing union that represents IT workers here in the USA? Perhaps we should ask them to come before it is too late.
Big bonuses will be had by execs for each full time employee who gets replaced by an outsourcer.
This is just insane. Doesn't BD realize that CareFusion had it's help desk outsourced with CSC and it failed miserably between the exorbitant cost and complete inability of CSC to timely address end user issues? CareFusion brought the help desk back into the company because of that utter failure. It is why CareFusion opened an office in KL, to provide an in sourced company location for the help desk. Doing so reduced help desk costs by a mere 65%.
No, this outsourcing has nothing to do with saving money, kick backs are afoot!
