Job Termination Lawyer in Orange County

This is my first post, I have been lurking here for months... I was terminated this week. I'll keep the post short, I was treated with disrespect, I was not provided appropriate supporting documentation and reasoning for my termination, there were multiple people on the same level who were left to work even though I was constantly flagged as a top performer. I would like to file a wrongful termination case and wanted to see if anyone had similar experiences and if you can recommend someone who can help with this. I've found a ton of contacts here in Santa Ana, but I am really looking for someone who dealt with Corinthian before. Thank you in advance and God Bless.

Tell us what the lawyer says once you decide what direction to take.

Company won't even exist by the time lawsuit gets anywhere, if it does. Being treated with disrespect is not illegal. You'll need tons of proof and likely not a lot of lawyers will take the case. You're essentially trying to sue for government finds. Not a winning situation. It's best to just grow up and move in. There's no money in the lawsuit.

If the termination was due to down sizing and/or your position being eliminated there is no grounds for a wrongful termination. If the grounds were performance related and you had been issued a performance improvement plan which you did not meet the required areas for improvement then you also have no grounds for a wrongful termination case. Also given their dire financial position if any judgment were to be on your behalf there is no guarantee it would be paid out if they file bankruptcy.

You have to be aware that discrimination exists at every level in any corporation. Just because someone likes or doesn't like you is moot. Only those types of discrimination that are prevented by law and can be proven will make a case. Wrongful Termination is extremely hard to win. Please consult with a labor law attorney, but don't let your anger get the best of you. Use the anger in a productive way to get a better position. Good luck and God Bless.

Good luck and I doubt you will have a case. At will is pretty ironclad in California. 508 hit it right on the nail. Unless you have any documentation that proves you were discriminated against or you complained to HR about something then you are going to have a tough time.

Regarding 507's comments, he's not a labor lawyer, so his opinion is moot. Talk to a labor lawyer (like those suggested) and get the info straight from the horses mouth with actual creditals to speak to whether you have a wrongful termination. Ignore the haters on here.

We need to create a class action lawsuit. CCI/Heald don't lay off people, it's all about firing us, just because we weren't the favorites to management, since I actually didn't falsified any signatures when completing students docs.

I am not the original poster but I can see many scenarios where he or she might have a very strong case here. For example, imagine him processing payroll, that's a key position and cannot be eliminated - so, now let's imaging that there are two individuals doing that job, and since we have less employees, we'll need to keep only one. let's say one person has green skin and the other person has blue skin, and the boss has blue skin as well. so, now boss needs to decide who to let go. the person with green skin is always on time, no errors in work, polite, everyone likes the green person. the guy with blue skin is mediocre when it comes to performance, tends to be late for work, makes errors etc. and somehow, the boss decides to keep the blue skin guy and axes the green skin guy becase he rally likes working with the blue skin person. there is your potential scenario, stuff like this happens all the time at all kind of companies. i have been pretty pleased with my environment here, managers are good and peers are just fine, however, i can see a scenario like the one outlined above happening at ANY company, it's just human nature.

out of couriousity, why do you think your rights were violated? you were employed 'at will' and the company did not want you any more and you were let go. so, what's wrongful there - the company is melting, falling appart, would you not expect that you might be let go? i do not see anything wrongful there.

Call Kar Gerber or Ann Guleser at 714-210-8000 and tell them that you were with Corinthian. They have experience with CCI, both are ruthless, they will represent you very well.
