Thread regarding CVS layoffs

CVS got raked over the coals by Judge Leon yesterday...

For all those who felt that this whole case was about the DOJ and the beef judge leon has with them, it is not about that anymore. In this latest court hearing on the merger, Judge Leon got a chance to see just how powerful cvs (and especially Caremark) is, and how more powerful they could get with Aetna, and he doesn't like it one bit. He didn't believe ANY of cvs' arguments, and told the lawyers, (my favorite line) you'd better cancel your summer vacation plans! Judge Leon will not approve this anytime soon. Oral arguments in this case are set for mid-July. How far can the judge take this case? We will find out! Corporate's gotta be fuming now! I couldn't be happier that cvs is getting what they deserve.

Please Judge do not approve and then we can say goodbye to Larry and his cheesy mustache for good. I don't want to see him sporting the yoga pant trying to sell his new concept.

I think that exchange was simply the witness for CVS, Mr. Lawrence Wu, trying to distance CVS a little bit from Caremark which is under scrutiny. As if to say, “No, that’s not CVS, that’s Caremark” And Judge Leon wasn’t buying it because he knew cvs OWNS Caremark! Cvs should know by now that Judge Leon is NOT going to fall for any of there “corporate spin”.

"Why do you keep calling it Caremark? CVS owns that, right? It's CVS; don't disassociate them," he told the witness. "It's CVS' PBM and it's one of the three PBMs that controls roughly 70% of the marketplace."

So is Leon's fervent intention to make it TWO PBM's (less Caremark) so that THEY can control 70% of the market?

I also liked the part where the CVS witness tried to disassociate cvs from Caremark, and the judge said, "cvs owns caremark right? Don't try to disassociate them!" #freeaetna is right!
