So the next court hearing was announced today, and it will be June 3rd. And it will last a maximum of 3 days. Per a different article, the DOJ is fighting some of the witnesses against the merger, trying to block them from testifying at the hearing. This is becoming like a game of chess. Each side is maneuvering for an advantage. Right now the momentum of this case is on the side of the judge. I am not sure what exactly CVS could do at this point to change Judge Leon’s mind. Never a good thing to pick a fight with a federal judge!

Not a trial just a hearing where witnesses will testify, 3 from each side, to provide the court with more information to help judge Leon make a final decision. However, it appears there will be additional court hearings about the merger BEYOND this next court hearing. This one is for witnesses, and additional hearings for lawyers to testify as well. How long will this go on?

Judge Leon actually referred to this as a “mini trial”, and journalists have said that what he’s doing is something that has almost never been done. Judge Leon is taking this merger case about as far as any merger court case has ever gone! Get ready for a bumpy ride if he orders cvs & aetna to separate!
