Judge orders ANOTHER court hearing on merger, in May, wants to hear from critics of merger...

So the judge continues the CVS-Aetna merger court saga. At a hearing today Judge Leon said he wants to hear from critics of the merger in May, during a hearing that could last a week! All this BEFORE he makes a final decision. This article I am posting is from Reuters news service...

CVS judge expecting merger hearing for May

A U.S. federal judgereviewing an agreement between the government and CVS HealthCorp allowing it to buy health insurer Aetna indicatedFriday that he wanted to hold a hearing in May to hear fromcritics of the $69 billion deal.

Judge Richard Leon of the U.S. District Court for theDistrict of Columbia said in a court hearing that he could takea week to hear from the American Medical Association and otheropponents of the transaction which closed in November.(Reporting by Diane Bartz; Editing by Richard Chang)

It doesn’t go into what happens if the merger isn’t approved in part, but the Judge could reject the merger, that is NOT off the table.

My favorite quote from the Judge in this excerpt from an article about he merger...

“In court, lawyers for the government and CVS tried in vain to persuade Judge Leon that live witnesses weren’t needed and would only complicate the court’s review, which they argued should be narrow in scope.

“That bus has already left the station,” he responded.”

CVS is getting raked over the coals here!

There are articles on LinkedIn that actually bring up the possibility of what happens IF judge Leon rejects the merger, which it appears is not off the table.

I am the OP of this thread, and I am NOT trying to spread rumors or fear, just stating the facts. Now I've tried to follow this court saga closely, but info is not always easy to come by, since these court proceedings don't always make the headlines, so you gotta search for them. One thing that has stood out to me as odd, is 3 times both the DOJ and CVS, have asked the judge to just approve the merger, and 3 times the judge basically said no. It's CLEAR that Judge Leon does NOT like the deal the Gov't made with CVS! And yet both cvs and the gov't continue to insist the deal they made is fine, please just approve the merger. In doing so, they risk aggravating this judge even further. They already p-ss-d him off when they treated him like a rubber stamp, and their continuing to do so. The gov't and cvs REFUSE to amend/change the deal they made, and now here we are with ANOTHER court hearing, where this time the CRITICS of the deal could get an entire WEEK to voice their complaints and concerns! This merger IS INDEED in trouble! If I am wrong and CVS somehow survives this process and wins judicial approval of the merger, then I will be the first to admit I am wrong! However, ALL the people who laughed at me, when I suggested this merger might be in trouble 2 months ago, where are you guys? Not trying to start a war, but do you believe me now? How many more court hearings do we need before we acknowledge cvs is about to really blow this one big time!

Cvs and DOJ both wanted judge to just approve the merger, and he said no. I think cvs and the gov’t don’t get that this judge does not want to be treated like a rubber stamp, and yet despite all that Judge Leon has said their still trying to ram this merger thru.
