Judge Leon seems bent on holding this next hearing, so my guess is he'll deny this request, and then the hearing will go on. Interesting twist is cvs proposed 5 witnesses of their own to testify in favor of merger. Except these people are cvs and aetna execs and one former gov't official. Not sure how the judge will feel about that, because with the exception of the former gov't official, the rest are company insiders, so of course they'll testify in favor of the merger. Cvs needs independent people to testify in favor of the merger and they don't have that.
this is not "worry" it is a court filing, like any good lawyer would file to get this moved along. basically says that what these witnesses will testify to is irrelevant so don't waste time.
