Thread regarding State Farm Insurance layoffs

Recalculated overtime payment?

I just got a letter stating that the farm has had to recalculate overtime due to bonuses (from back when I worked at the farm) and I'll be betting a payment in the next week or two (reported to the IRS for withholding purposes of course)

Did they get in trouble? fail an audit? any idea how much OT we're talking about? Anyone know what years this covers? (I was only there for one month in 2018)

My letter had the number 97 on it. Also - my lawyer said the agreements we signed in the transition do not release wage and hour claims. And you can file for the unpaid wages with a state agency and don't need a lawyer. But the letter was the recalculation of overtime payment.

What is a 97 letter?

I got the 97 letter. I am in California. I talked to a lawyer. They should have paid this to us when we were terminated. My lawyer says there is a case for penalties and interest. Maybe a class case. Said they owe 30 days of wages now.

$13, sounds about right...

Any idea what time frame that's for?

Don’t get too excited. We got the letter earlier this week, and it was added to this week’s paycheck. A whole $13.00! And I have been with the company over 25 years.

Even if it's just a hundred or so dollars, I'll take it.

Former employee here as well. I’m wondering now, worked just shy of 6 years in claims and eight the exception of a few months, I pretty much worked overtime nearly the entire time. Wondering if they will do this for all years however far back or just last year? Anyone know?

Having been through this at another company and at the Farm years ago, they most likely got tagged for not paying hourly workers for all correct hours. For instance, if you were required to be logged in and ready for calls at the start of your shift, you should have been paid for the time to log-in and get ready to take calls. Likewise, if you were to take calls until the end of your paid shift, then still need to log-off your systems, you should have been paid for that. The Farm must have been reported to the state or feds. They could be required to pay unpaid wages for years to anyone in that or similar roles

I received the letter and had a few thoughts: 1. It doesn't say how far back the farm will be going to re-calculate the retro OT, so I am assuming that they will only go back as far as individual states require them to. 2. Retro OT was always a small amount, say a few hundred dollars, so I am not getting my hopes up for anything substantial. 3. I doubt that they are doing this from the goodness of their hearts. Something had to have taken place to make them recalculate pay, especially to those of us who have left. 4. I will gladly take whatever they want to throw my way at this point.
