I'm sorry if this was asked before, but I can't find it.
If you are laid off with unused PTO is it paid out as part of the severance or do you lose it all?

No, you don't understand flexible vacation - you don't accrue it, there's nothing on the books for "unlimited" vacation. It's not called flexible, but if you had "real accured vacation" built up before they forced "unlimited vacation" 2 years ago - you can still get paid for the remaining hours if you leave or get rif'd.
For anyone thinking of leaving or worried about getting laid off, this does emphasize that you should think about taking your flexible vacation on a regular basis so you don't "lose money" when you leave.
Please use all accrued time off before the next layoff - the executive team :)
Took a huge beefier today at the bell.
If you are salaried in the US, and have time accrued from before they moved to "flexible vacation" then you will get the PTO in your check. If you used it all up, then you are out of luck. Remember they also used to "steal" 4 days for the US during the recently mandatory "winter break". Now I work at a place where you get that holiday week off and they don't make you use vacation, just like it was at Sun. So glad I'm not at Oracle anymore where they are always trying to find ways to screw people.
In the US, you are owed unused PTO as long as it has not expired, and that you actually accrue PTO (not the unlimited bs as mentioned below). Dont know about the socialist republics of Europe
A lot of companies are switching to the "unlimited vacation" plan to avoid accrual issues. If you have a good manager it can work out for you, as Oracle's old annual cap was rather low. But yeah, no payout when you leave the company.
Since I was laid off BEFORE they got rid of the flexible vacation policy, I received all my final PTO/vacation in my pay. Sorry to hear about the changes. Sounds ridiculous, IMHO.
I received pay for all unused vacation days in final check, salaried
Any accrued vacation listed on your paycheck would be paid. However, if you are subject to the flexible vacation policy, you may have already used up any remaining hours accrued before the switch. Nothing from the flexible vacation policy would be paid since it doesn’t exist on the books.
Unused PTO used to be laid out but then they got rid off the accrued vacation concept so no more, saves these bastars a few bucks because they are not making enough money already. Your charitable contribution to the 3 stooges bonus pool
If you are salaried, then there is no PTO. If you are paid hourly, then you get paid the vacation hours that you have accrued (a/k/a PTO, I guess)
