The poor, unfortunate, dedicated peons will get laid off while the no nothing management who got the company into this situation get to stay. Something is wrong with this picture.
I forgot, what was I thinking, EF was always the black sheep and was given the shaft
It is legal as its a different site
Question, EF employees that were laid off were only given 60 days pay, not 90 that Malta was given. Is this legal ? Someone contacted the NYS WARN act office and they were looking into it. Curious if anything can be done .
Links about H1b may consider as temp worker:
NYS warn regulation: Subpart 921-5 https://labor.ny.gov/workforcenypartners/warn/pdfs/Text_of_New_York_State_WARN_Rule_7-10.pdf
USCIS H1b

Disclaimer: Not a lawyer, just share some web links
please share link which mention about exclusion of H1B workers a and less then 6 months.
Now these numbers make sense. That's why total employees on site is left blank and so real number does not show up indirectly .
The WARN regulations allows exclusion of the temporary workers such as those on H1B visas, so probably the actual numbers are probably significantly higher with them included.
Folks less than 6 months with the company are not needed to be counted.
This notice did not include Fishkill site ~37 and several other sites such as Bangalore, Singapore and Santa Clara/ Austin etc.
455+37+other sites=650+
We will never know the fuzzy math used.
I think the November date is 3 months + August so they are talking about this week’s layoff. Correct me if I’m wrong!
