FMLA only covers for layoff or termination in regards to the reason for leave, such as maternity leave....family crisis etc. So yes, unfortunately, you can be laid off during FMLA. But, In the same token the company would really have to show you a reason they did lay you off and you may be more privy to the way they decide this because it could be a lawsuit too, showing that you were not protected for the layoff.

In the policy it states that FMLA can be affected but it will not be until they return to work.

I don’t know just the laws exactly, but if it a RIF & not specifically you being let go, o think they’re able to do it. Also, for a PHC for example, the entire role is gone, do they can & will let you go.

People on FMLA CAN and HAVE BEEN affected. Yes. My friend was on FMLA for having a baby and didnt learn about her layoff until her team told her to check her email that she was laid off (not coming back). This was last layoff round, not current one, fyi.
