Thread regarding Hewlett Packard Enterprise (HPE) layoffs

Can HPE deny/refuse my employment after acquiring the Company I'm working for?

Hi. I was fired from the old HP in 2010 (not WFR, but fired "with cause" - long story), and I moved on with my life. I currently have a Senior Director position at a small Network Security startup, and HPE is in advanced conversations to acquire us (sorry, can't disclose the name).

There are still a lot of people I used to work with in the new HPE, and I'm sure rumor will spread quickly about my termination back then. Can HPE deny/refuse my employment after acquiring the Company I'm working for when they find out? I assume they can WFR me at any time, but I wonder if my past termination at HP would be enough to deny my employment, or terminate me immediately without any severance.

Do you have an employment contract with your current employer? That will govern what HP can do since they must abide by the contracts signed by your current employer. If not, you are most likely an at will employee which means either side can pull the plug at any time.

When you are working at a company already, and that company gets bought up by another company, the HR records are just assimilated by the buying company, and the newly-acquired employees (as a group) have little if any of the extensive data-gathering applied to them, as one would expect of a brand-new individual new hire. I would definitely question what Rj8kmHW-gvb said here...

Still, starting to look for a new job NOW, is almost definitely a good idea, as absolutely atrociously shabby "job security" is at HPE... Just read these pages here, or "Google" it...

I haven't been at your situation, but common sense tells me you'll need to submit kind-of an application for employment at HPE, and I bet they'll ask there if you worked at HP in the past and most probably will dig in more once you say yes. I can imagine what a nightmare it can be escaping from this h-ll and coming back through an acquisition.

Regardless of the reason you were fired back then, you raised up and remade your life and rebuilt your reputation. Why would you put that at risk by coming back? Seriously... You know really well what will happen to you sooner or later if you come back (definitely not worthy), so if I were you I would jump that ship as soon as possible and avoid the nightmare.

I threatened to sue HP for age discrimination a few years ago (it was a very clear case, they laid me off and immediately replaced my exact job function with a younger person, 4 or 5 job grades down, and I hear that he or she barely shows up for work now, and the work no longer gets done, but I digress...). I applied for the job opening, to make sure I had a clear case... Anyway, it went to arbitration, and they had to keel over dead. The best that they could come up with, was I got a "D" on my report card (per their subjective choice), and so that "D" means I am not qualified for a job, 4 or 5 jobs grades down, I'd be curious to see what a jury would say about THAT!

In the long-long doc I signed to get my money, I saw mentioned I can never-ever apply to an HP job again, BUT, I saw specifically mentioned, if they acquire a company that I am working for, I can keep my job. So this is similar to what you are looking at, so I'd say that you are as "safe" as anyone else is, but they can probably WFR you like anyone else. So "safe" isn't very "safe" anyway...
