Not 100% if there is compensation to be gained if you signed severance, but the investigators are interested. If you can identify a similar skills are yours vs. the H1-B hire list, you have a case.

All you need to prove is suspicion. Or like me, having trained a newly hired H1-B to perform your job function. Even if in another dept. Dept of Labor will open investigation across the entire company if it involves a layoff. Remember, any H1-B hired w/in 90 days prior or following your termination with "similar" skills is violation of the law. I'm guessing their could be dozens of violations, in not more.

My suspicion is that nike has covered their tracks well enough that it would be hard to prove. Shortly after I was laid off my position was posted with a few changes so that it wouldn't be the same job.
I suspect it would be hard to prove in a court of law. From what I've read, age discrimination can be incredibly hard to prove also. If it wasn't I would think we'd be hearing about lawsuits by now.
