Laid off with no severance

My BIL was let go in this last HPE layoff round and they are not giving him any severance. They are not even paying him for accrued vacation time. Is this even legal? He has been with HP/HPE for 15 years but is one of those who started with DEC which was then acquired by Compaq which was then acquired by HP. 33 years in total and nothing to show for it.

A layoff is termination without cause. The company has lost their "willingness" to employee you by no serious fault of your own. A termination with cause is due to resignation where the employee forfeits their will to work for the company any longer OR commits any type of misconduct that carries the death penalty for their job at the company.

I was laid off with a little more tenure as your BIL, and HPE has done exactly what they promised to do so far. If you are selected for WFR, consider yourself on probation until your last date of employment. Keep it professional because you can still be fired for misconduct up until you last day. If you get pissed and quit, bye, bye severance and unemployment benefits in some states. Mandatory unused vacation payouts depend on the state you are in.

Yeah, it's legal. Not common at HPE, however, per other comments.

I agree with the last poster. The WFR policy was 60 days of pay plus a severance based time with the company. The severance should be about 15 weeks of pay. I would question if he was terminated. If, so he will most likely not be eligible for State unemployment benefits. As for vacation, unless you reside in a state that requires the employer to pay, your out of luck.

No one is getting to cash out vacation.

Are you sure he wasnt caught stealing, violating sbc? Usually thats the case for termination with no severance.

Everyone I know that got the axe received at least something, paltry as it was.
