Who has hired lawyers to negotiate your severance?

Who has hired lawyers to negotiate their severance or even initiated legal action? What was the result? How quickly does HPE cave? How much more did you get? Curious minds want to know...

I was hired June 2016 in the Big Data Sales Group at CSC - we hired about 5 people by August. Exactly 5 weeks after I was hired I was called and told CSC laid off almost all of the sales team. We received ZERO severance - just 2 weeks notification. Trust me, CSC is calling the shots on the HPE layoffs and the days of HPE giving 2 weeks per year or giving you 2 months notification to find another job internally are over.

My advice to anyone at HPE is to be proactive and get out of there - there is going to be no pot of gold waiting for you with your layoff notice!

We have an appointment to speak to a lawyer in Tulsa, Oklahoma.

I am interested in what the lawyer said. Myself and my team were also "unofficially" notified that we would be WFR'd and then told that there was a hold. We were sent documents so that we could figure out our severance which we did. We were ready to be notifed, when they pulled back. Now we are just waiting for DXC to come along and boot us out the door with nothing near what we would have gotten. There are more of us out here willing to ban together if we can and try to get what we should have gotten.

We have an appointment to speak to a lawyer in Tulsa, Oklahoma. The reason for this you ask??? we were told we had over 25 years of seniority and they would be getting us out before this merger, our jobs would be insourced at that same time. "They" management/HR wanted to make sure we would keep the severance that HPE still had. Tuesday 14th they put a freeze on any layoff until after the merger. We all know what that will mean to us!

I'm the "8x" poster. I didn't say I got 8x the number of weeks they offered, I said the total package ended up 8x the original offer. Including bonus, vacation, medical, etc. There is more to negotiate than just the number of weeks.

Like I said, I recommend talking to a lawyer. You have almost nothing to lose and a lot to potentially gain.

Could you guys please indicate what country, or at least what region, you are in? I'm having trouble believing that anyone could get 24 months severance in the good old US of A. Or that a lawyer would make any difference here in the states unless you had a open and shut case for discrimination.

Some Tulsa employees were supposed to get laid off before this merger so they could keep the severance as it stands today and found out yesterday HPE put a freeze on all lay offs until after the merger. Why do you think they would do such a thing???? Severance changes and they can save more money??? It s---s!

@ @MhoLlHJ-2hrt I have hired a lawyer. Its very slow going. So far we're at double the original offer...not 8 X lol! (12 to 24 months) Just curious about how it will all end up. THanks for posting.

I did. The lawyer sent a few letters back and forth with HPE (who were very slow to communicate back). The process took a few months, but was well worth it in my case. I ended up with about 8x their original offer.

Lawyers aren't that expensive and it's unlikely you're going to end up in court anyway.

Obviously, there are a variety of factors here including your position, your country/state of employment, age, and more. There are also various things to negotiate -- salary, vacation, bonus, stock.

I strongly recommend finding a lawyer and having a consultation to see if you have a case. You have almost nothing to lose, since many lawyers will do an initial consultation for no charge (or maybe $100 or whatever).

Well, I think it depends on your situation. What country your in etc.. Country laws are different. I know from first hand knowledge (FY2015 alumni) engaging legal council resulted in a significantly better settlement from first offer to close. Took a couple of months but well worth the effort.

Don't waste your time with a lawyer. With the liberal court system, retainer fees, other costs it is not worth litigating this with a bunch of irrational corporate and legal pigs. Move on in life and become a franchise owner at an established and successful fast food company.

This is essentially incorrect. In the U.S Federal law provides that HPE would have to give 60 days notice of a layoff that would affect you, with many states having stricter requirements, or pay in lieu of notice. So unless HPE changes how they layoff employees, the package will always be at least 60 days.

You aren't legally entitled to any severance. Be happy you got anything, because the people laid off a year from now will get even less.

And if you are unhappy about it, quit dogging on unions. Otherwise, start your own company or quit your whining.

I'm confused about "negotiating my severance". Maybe the laws are different where you work, but in my section of the USA there is NO legal obligation to pay ANY severance. Employees work "at will" and can be terminated at any time and for any reason (or no reason). Companies (HPE) have historically paid some sort of severance strictly as a public relations gimmick. But there is no legal obligation for them to do so, therefore nothing a lawyer can do except take your money.

It really depends if you can prove there was some injustice done. Even for a civil suit where the proof of guilt does not have to be proven 100% to be their fault.

Well, this is one of those “Socratic” things… The answers to the questions are more questions!

Do you live in the USA? If so, then… How much justice do you want? Then, how much money do you have? How many lawyers can you afford? Keep in mind that Meg is a $billionaire, and that She can afford more justice than you can! Also ponder, can you demonstrate to The Donald, that you voted for Him? Better yet, that you contributed to His campaign? The Donald does not take kindly to those who oppose Him, or who have, in the past, opposed Him! But if all is favorable, you might appeal to Him…
