Is University of Phoenix Violating the Telephone Consumer Protection Act (aka Do Not Call Registry)?

Are University of Phoenix enrollment reps violating the Telephone Consumer Protection Act (aka Do Not Call Registry)? If so, has anyone talked to their enrollment managers about this?

A lawyer in Beverly Hills, California is making the claim that his client was the victim of unwanted telephone calls by the University of Phoenix.

"Twonesha Johnson-Hendricks filed a complaint on behalf of all others similarly situated on June 24 in the U.S. District Court for the Eastern District of California against University of Phoenix and Does 1-10 alleging violation of the Telephone Consumer Protection Act. According to the complaint, the plaintiff alleges that between Aug. 12, 2015, and Aug. 13, 2015, she was contacted on her mobile telephone without her consent by the defendants. The plaintiff holds University of Phoenix and Does 1-10 responsible because the defendants allegedly contacted plaintiff to solicit their services despite her number being registered with the National Do Not Call Registry." "The plaintiff is represented by Todd M. Friedman and Adrian R. Bacon of Law Offices of Todd M. Friedman PC in Beverly Hills."

Another telephone-related lawsuit was filed against University of Phoenix in Pennsylvania earlier this year, however University of Phoenix was using an automated dialer.

"Ciara Connolly filed a lawsuit June 10 in U.S. District Court for the Eastern District of Pennsylvania against The University of Phoenix Inc, alleging violation of the Telephone Consumer Protection Act. According to the complaint, Connolly began to receive calls from University of Phoenix on her cellular phone in February 2015. The university used an automated telephone dialer system and prerecorded or automated voices, the suit states, which the plaintiff heard when she answered the calls. On Feb. 20, 2015, the lawsuit states, the plaintiff mailed the university a letter, asking that all calls to her phone be stopped. However, the calls continued, the suit states, which incurred fees for the plaintiff." The plaintiff is represented by attorney Jody B. Burton of Lemberg Law LLC in Stamford, Connecticut.

Look, it's not that we're intentionally trying to violate the do no call registry but there are grey areas, especially if I'm trying to call outs or trying to get a student to pay their balance. Often students place their number on do not call after racking up a balance and I will call anyway just to send them to collections. I really don't see a problem with this, I mean they owe the balance, they should pay!!! School is not free. Ok breaks over.

They violate laws daily because it is cheaper to just pay the fine or pay someone off from the slush fund. The few times they had to pay out pale in comparison to what they are getting away with. This company is one of the most corrupt organizations I have worked for and I worked for the government at one point.

Of course they do! They force us to have 6 to 8 referrals every month. Students dont always have legitimate referrals. If they had a legitimate referral that referral would call the main phone number and enroll his/herself. Instead we Have to enter whatever numbers we can find if they are on a DNC list somewhere they get called anyways.
