One of the reasons this downturn was so vicious towards older workers is we no longer have any safety net. "Right to work" is "Right to Fire" and it's black letter law in most states. Lawyers don't work for free. They will not take the time to enforce the laws on the books unless victory is obvious and inevitable. Then they want 40%. If you're working for a living, you're on your own.

Sort of. They were suing based on a implied contract due to the length of service to the company. After 15 years or so, employment is "assured" as long performance permits, under this implied contract. There is an age component to this, for certain.

There is no lawsuits to be filed here. If you don't like Follett leave, or just put in the bare minimum until you are fired. Look around at the employees that are still there. Many are some of the poorest and laziest employees around. Morale is zero after 4 years of constant layoffs. If you work hard, it is not a defense to not getting laid off. Look at some of the employees let go, they were the were contributors and very bright.

No worries, be happy. We laugh at all your bickering and soon we will be buying your brick and mortar business. Seeing you are failing, why keep the executives on? We will kick your executives to the curb with no severence package for them and probably end up hiring some of you unknowingly. Take it from an ex Follett employee, recent Amazon hire and have that beer and watch. Grab a 24 pack. It will not be overnight.

They can claim first in and last in were let go. That would generally balance out the age groups alone. If you wanted to target the most expensive and older employees then sacrificing the new hire along with them is an easy and cheap way to do it because the new hire won't cost a thing in severance.

I got let go and a normal response is to want to get them back for it but it isn't worth your energy. Know that they will be out of business sooner than later and pop a beer when you hear or read that those K-Mart clowns all got fired.

In order to sue for age discrimination you would have to be able to prove that layoffs occured only on the basis of age and nothing else. Being that age is a protected class it is auitable for a lawsuit.

Im sure follett was smart enough to throw in a few people of younger years which makes the process exponentially more difficult to prove.

You need a human rights or labor lawyer not just any lawyer. If you need a few names please let me know. I know a few people.

No lawyer would touch my case on a 40% or 50% contingency contract. They all said it being dicks isn't something you can sue over. Even if you can show the people they laid off were senior (which we could), that wasn't enough.

However, I never signed a NDA. If you find someone, please post about it.
