Thread regarding Qualcomm Inc. layoffs

Looking at all the complaints from this board about corruption in hiring/firing process, phony PIPs, excessive top executive compensation,

H-1bs hiring practice when so many Americans are out of jobs, etc... one has to wonder why there is no class action in the work?

@6mjk: You may be right that most people won't have cognizable claims. But emotional abuse IS abuse. A lot of bosses are bullies. There is also such a thing as a hostile work enviornment claim --but it is difficult to prove. Also, if the abuse is in response to utilizing internal procedures, such as speaking to HR about a problem, or filing an ethics complaint using the QCOM hotline, this is retaliation--which is also a separate claim.

@ 7sre: Not necessarily. Certain federal claims cannot be waived for the de minimus amount that Qualcomm gives the people they PIP. Some cannot be entirely waived at all. The difficulty with a PIP is proving that the employer abused the process--and this is where most employees lose out; because agreeing to the terms of the PIP is often an admission that your work is below thee level of an employee who is a qualified hire for the position. It's extremely difficult because the courts will not second-guess the employers' motives or evaluations. What you need to look for and be able to document in order to win are situations where there was retaliation against use of internal grievance process by the employee, violation of the company's ethics by the employee's supervisor, and violations of law or public policy by the supervisor BEFORE you are actually put on a PIP.

Because of you take a severance you sign away your right to sue. And those with real litigation issues are the first ones QC tries to PIP or layoff. The ones that stay usually can't prove anything which is why they are allowed to continue working. QC is not stupid. They do not lose employee lawsuits.

In my opinion, everything that is reported in this site, related to the management, horrible work culture are mostly issues that can be filed as unethical, lack of integrity and basically nasty work environment. Most of it caused by director level and above. Almost all director here are just freaking jokers with zero management or technical smarts.

Although some issues can possibly be filed as emotional abuse by managers. But nothing I see can be filed as illegal per se.

So not sure if any lawsuit can be filed.

When I left QUALCOMM I got as sr engineer I got a job as engineering director for &250K a year. At the recent company I'worth more than $800K so far.

Employment class actions usually just make the lawyers rich. People need to grow a set and file the suits on their own.
